staff recommends that Council approve the attached agreement between the
City of Pale Alto, the city of Los Altos, and the Los Altos county Fire
Protection District for the joint staffing ~nd operation of Fire Station
8 in Foothi 119 Park d-uring the 1992 S1.ln' . .:mer fire season.
Backgrouns!
Over the past few months~ staff h3S been studying and discussing fire
station location and consolidat.ion feasi~ility at two sites 'With the
cities of Los Altos and Mountain Vie~. The proposed agreement is an out
growth of those discussions ~ith Los Altos Fire Department and the Los
.Altos county Fixe P!:otecticn District:. Palo Alto and the Los Altos
County Fire Protecticn District have contiguous boundaries and similar
fire protection needs~ The City of Los Altos contr-acts to provide fire
protection for the Los Altos county Fire Protection District, and
currently opere-.tes 'With Palo Alto under auto!natic and mutual aid
agreements. The proposed agreement improves the initial emergency
response capability to firE' and rescue emergencies for both
jurisdictions •

The Joint Po-.ers Ag=eement provides a -mecha.nizm to address the.
capabilities required to re:.;pond to and effectively handle fice and
rescue situations in the foothills area which adjoins Palo Alto and Los

reduction in overall e.xpense.s, while all partir:.ipating l!I.e"t!lbers will
obtain an increased availability of staffing resources during emergency
opera.tions ..
The managament of the joint program is detailed in the attached Joint
POYers Agreement along ~ith methods by which administrative; operational;
policy and decision making authority will be handled by each
jurisdiction.
The aqreement discusses ho~ and ~hp.n the additional staffing resources

payment 'Will be made by the Los Altos county Fire Protection Distrjct to
the city of Los Altos. Palo Alto is identified as being responsible for
comman~ and superv~sion of all personnel assiqnad to the station.

RecOmmendation

District, a California county fire protection district

WIT N E 5 SET H:
WlIEREAS, the parties have detet'lUined that there is a
mutual need for a joint staffing of the City of Palo Alto Fire
st~tion Number 8; and
WHEREAS, the parties desire to enter into an agreement
pursuant t;O Chapter 5, Division 7 of Title I of the California
GOVernment Code, cO!1U!lencinq with section 6500 (the -.1PA lav") (
authori~inq the jOint exer~ise of powers for the operation of a
jointly staffed fire station. and
WHEREAS, Palo Alto and Los Altos :maintain and operate
separate fire. protection orqanizaticns 'Within their re.specti"l"!
boundar iea; and
WHEREAS, Los Alto& contracts with the District to provide
fire protection services to the area ~ithin the boundaries of the
District; and
WHEREAS, 1'3.10 Alto and District have contiT..lOUS
boundar!es and similar fire protection needs~ and
WHEREAS, Palo ~lto owns and operates Fire Station N~r
8 located in the Palo Alto Foothills parK, 3300 Page Mill Road,
Palo Alto. This stat~on is staffed on a seasonal basis (fire
season) during the summer. Normally, tl'l,e fire season begins on or
about June 1 and continues through october 1 of any given year; the
fire season may begin earlier and continue t~rough November of any
qiven year. The parties propose that this station be jointly
staffed for the 1992 season; and
WHEREAS, Palo Alto~ Los. Altos and District wish to
coopera.te in the joint staffing of Palo Alto Fire St.ation NUlI"lber 8;

NOW, THEREFORE, it. is agr-eed by an~ bet'.;een the parties

1. One employee from Los Altos and twc from Palo Alto
will b~ assigned to Fire Station Nu.mhcr e on a 12 hOur basis
{8: 00 A.M. -S: 00 P.M.) wher. the fire danger ratir.q is lOI;,'/medium/
high. Whe.n the. f"ire danger ratir.g is e.xtreme, the staffing ..... ill be
increased to tw"o (2) Los A.ltos employees and t ..... o (2) Palo Alto
e:Glployees on a twentj~-four hour basis~
2. Los Altos employees vill be under the command and
supervision of the Palo Alto offl.ce:-assigned to Fire Statio!':l
Number 8.
J ~ District wil..l pay" the salary (5) of the Los Altos
elllployee(s) assigned under this agreement.. Los Altos .. ill provide
District with an invoice reflecting the personnel assigned,
includinq dates and hours. This invoice for payment will be
forwarded no later then the fifteenth (15) of each month that this
aqreement. is in effect, beginning the ZIlonth that this agreement is
3uthoTizeu~ Salary under this agreement is the hourly overtibe
rate for a Los Altos Firefighter/Engineer at -E" step~
4~ Each party shall continue tc provide all applicable
emplcyee benefits for its respective employees assiqned under this
agreement, including 'Workers' compensation coverage. Each employee
agsigned under this agreement shall continue to be subject to the
p€rsonnel rules and regulations of his/her re&pective employer, and
with any labor contract to which he/she is a party~
5. Palo Alto, Los Altos and Distrlct a~ree to prepare
and utilize an OPEP~AL J.~.1~rE.R OF UNDERSI~NpING t~o define actual
practices and procedures of this agreement. The respective fire
chiefs of tt,e aforementioned jurisdictions It.:!)' modify the
~TIONAL LET'rER O~. UNDERSTANDING based on the best interests of
all parties.
6. TERM.. This agreemen.t shall be in -ef feet for a
period of seven (7) months from the date herein above written
unless sooner terminated by either of the parties qh'ing to the
other fifteen (15) days written notice of s~ch terminatio~.
7. Each party agrees to lndeanify, d~!end ;and hold
harmless the other parties, their officers, agents~ and: employees
from any and all demands, claims, or liabilit.ies of any nature,
including death or injury to any person, property da~aqe or any
other loss, caus~d by or arising out of the negligent performance
?r failure to perform this ~g~eement.
