This report recvmmends that Council approv~ the attached amended
agreement. "With Roto 'Rooter to contract for se\o,'er lateral
maintenance service, on a regular basis, and 4ut~orize the Mayor to
execute such agreeme.nt. Funds for t.nis specific purpose have be1!r.
approved in the Utilities budget tor EY 1992-S3.
Background
Sewer lateral maintenance was first contr~cted in the second halt
of FY 1989-90 on an experimental basis. As a result af the success
of the experiment, the program was extended; and three-year
contracts were initiate.d in 1990 with two contractors. The proqram
has continued to be a success, allowing the Utilities Depart~ent to
lI'laintai.n a hiqh level of service .. ithout staff increases, and
without degrading Field S~rvice response. times or decreasing public
safety.
Staff has ccntinued to evaluate performance and believes that the
City ~as now had sufficient experience with the program to make it
unnecessary to utili~e two separ-ate contractors to ensure that
$ew~r maint-enance worKload is perforJned en a timely basis and with
a high level of reliability. Dispatching se~er calls to only one
contractor-'Will significa,ntly simplify such tasks as reviewing
billing, evaluating claims tt.at ~ay result from sewer backups, and
providing accountability for-services performed while at the
customer residence~ Ultimat~lYt this ~ill develop better service
to our resid.ents and customers at no ad,di tional cost. Based on
teedlJack from our customers l Rotc-Rooter has provided a higher
level of service on a mere consistent basis than the other
contractor, Rescue Rooter.
The original rationale for splitting the "Workload bet'illeen t,*,o
vendors was to ensure that vendors had the capacity to respond
within the ona hour (significantly less ir. the case of emergencies
where a sever backup occurs i~side the premises} time frame that was

Approval of the amendment to the agreement with Roto-Rooter ~ill
not increase the total expenditure from the currently-budqeted
level of $125,000 for the Fiscal Year, and the rate charged by the
contractor remains unchanged. Approval will increase the maximum
compensation amount from $62,500 to $125,000 for Rotc Root~r, but
by eliminating the second contractor, it will result in no change
to the total expenditures for the program. The only other change
to the current aqreement relates to the term, whict-is being
extended to June 3D, 1993.

"CONTRACTOR" ;

related. to sewer back-up respcl1se for the CITY Utilities
DepartJnent; and
WHEREAS,

NOW, THEREFORE, in consideration 'Of their. mutLial
covenants, the parties hereto agree as follows:
SECTION 1. The following sections of C'Ontract No~
SC010044 are hereby amended to read as follows:
a. ~~RMS. The term of this Agreement
is hereby extended to June 30, 1993~
unless sooner ter.-ninated as provided
herein.-
b. "COMPENSATION'. CITY shall pay
CONTRACTOR for the full performance
of its services under this amended
Agreement in a sum not to exceed One
Hundred Twenty-Fiv~ Thousand Dollars
($125,000) for fiscal year 1992-
1993."
SECTION :2. Except as tLerein modified, all other
provisions of and exhibits and amendments to said ccntrect,
