This report recommends that Council approv9 the attached consultant
agreement ~ith Terratech, Inc., in an amount not to exceed
$106,500, to provide materials testing services for various
cons-t;ruction projects. Fur;ds have been appropriated in tJ1e
specific capital improvement projects listed belo~ and the Public
Works Department operations Division FY 1991-92 operatinq budget~
Discussion
The construction projects in the Capital Improvement Program and
the Utilities Departmer.t operating b1Jdget often require inspection
and testing of construction ~aterials to ensure acceptable levels
of quality. Exa1nples il\cll:,'~e st.eel, )ilelding, concrete, insulation,
building, and road construction materials.
In order to provide these services, staff has solicited and
received quotations from seven qualified testing firms. Based on
the schedule of rates and the laboratory capabilities for materials
testing, the firm of Terratech. Inc. ....-as selected in accordance
with the City's procedures for consultant selection. Terratech,
Inc. was selected because of their previous ~xperier.ce worki~g ~ith
other cities on similar projects and because their testing prices
~ere the lowest overall. Terratech's staff has also worked ~ith
the City of Palo Alto and is kno\lledgeab~e about. t.he City's working
process.
The consultant selection ""as not required to be brought to the
Fir.ance Com::rr.ittee for its consideratiort. as the agreetrLent involves
routine services only~ The agreement provides material testing and
inspection ~ervices through June 199J. Funding is available from
the f~llowing CIP projects:

The 2!igreement also provides $40. 000 for utility trench testing
services, $20,000 in FY 1991-92 and $2a,DDO in FY 1992-93, to be
funded by the Public wo~Jcs Departl!lent Operations Division operating
budget. The second year funding is subject to Council approval of
the FY 1992-9) budget.
£2Df1ict of Inter~st Code Exemption
Staff (with the concurrence of the City Attorney) has determined
that the consultan~ is exempted from the requirement to execute
Form 730 ar.d otherwise comply ~ith the financial i~terest
disclosure provisions of the City's Conflict of Interest Code,
~cause the consultant's range of duties and the services to be
provided under the agreement for consult~nt services are limited in
scope and primarily mi~isterial in nature.
Reco1'1mendation
staff recommends that Council approve and authorize the Mayor to
execute the attached consultant agreement w-it.h Terratech, Inc~, in
an amount not to exceed $106,500, to provide materials testing
services for various construction projects.

on-call construction materials testing and inspection services
for various capital Imp~ovement Projects and compaction
testing for utility trenches including:

Steel Testing:
o Tensile and bend tests of reinforcing steel up to No. 11

Verbal reports on test results shall be issued to the
coordinating Project Engineer withi."i 24 hours of the tEosts
taken. All lorritten laboratory repo!:ts Sohall be issued to the
Project Engineer within one week of the tests taken.
The response to this proposal shall contain a sc:tJedule of
rates (priced on a per test basis, except tor In-Place Nuclear
Density Testing which shall be on a hourly rate basis). The
tests rates are to include all field and laboratory testing,
scheduling of testing, report preparation, mileage and other
indirect ~xpenses.
c. SCHEDULE
The work under this cOl"'.tract will be -Eo"r a two year period and

E ~ PR9.JEC'f ADMINISTRATION
The contra~t will be to provide testing services on various
CIP ana utilities projects durinq the life of this contract.
All request for testing serr.rices .'i11 be made by either the
Proj ect Engineer or tl",e Publ ic ,",'orks Inspector \ori th the
appro·,.ral of the Proj ect Manager.
All test resul~s and invoices shall be directed to the Project
~anager and should list the person requesting the test and the
correspondinq project.
