This report requests that council aWZlrd a cOT.tract in the amOUl"lt of
$465,230 t,o West Valley Construction Company, Inc~, for water main
replacements on California Ave~ue and Pri~ceton street in College
Terraoe~ In addition, staff recommends that Council authorize the
City Manaqer or his designee to execute one or ~ore change orders
to the contract with West Valley construction Company.. Inc4 for
additional relate.d but, unforeseen work. The value of t.hese change
orders shall not exceed $69.784.50. Funds for this project will be
carried forward from FY 90/91 Capital Improvement Program budqet
for water main replacements.

As vater distribution systems age, it becomes necessary to replace
the mains on a cyclic basis. Replacement becomes necessary when
the existing mains show extensive siqns of corrosion, are subject
to re-occurrinq breaks which cause extensive maintenance
expenditures, or when the materials of construction prove to be
inadequate. In very old water systems, some mains are inadequatp
in size to supply required flo~ and pressure for fire protection.
Staff bas identified the mains in this proje=t as being subject to
re-~lrring breaks.
Project pescription
The proposed project will replace 4960 linear feet of deficient
water .ain as shown on the attached map. Phase V of the Water Main
Replacement Project continues an approximate lOO-year replacement
cycle for the City's Water Distribution System.
When the Finance and PUblic Works Committee condUcted its annual
project review~ this project was not selected for further review by
the Co~ittee or partiCipation in selecting the contractor. staff
selected West Valley Construction company, Inc .• based upon the
contra.ctor's qualifications, experience I recently completed
projects and lov bid price for the project.

competitive bid. Bids were received
on July 9, 1991, as indicated on the
Th. apparent low tliddar at the bid opening was James Chalm-ers.
Subsequently, Mr. Chal.era has requested that his bid be withdrawn
due to an error in his bid calculations a He failed to include tha
cost ~or paving, which amounted to $99,600. This amount, including
his bid bond, would have increased his b1d to $466,850 instead of
$364,590 as indicated in his original bid.
Relief of Jia Chalmers' bid was discussed with the City AttorneyYs
ottice. Vnder Public contracts C~e Section 5103 (which is
incorporated into the contract specifications), a bidder may be
allowed to withdraw his bid provided certain criteria are met.
After reviewing Kr. Chalmers bid docw:tlentation with the Ci tlr"
Attorney's office., staff has deterJllined that Mr. Chalmers may
withdraw .his bid based on the criteria specified in the-Code.
Theretore.. the next lowest responsible bid of $465,230 has been
submitted by west Vall~y Construction.

staff reCOlmlends that Council:
1. Authorize the Mayor to execute a contract with West Valley
Construction Company .. Inc. in the amount of $465,230 tor the
Water Main Replacement Phase V; and
2. AuthoriZe the City Manager or his designee to negotiate and
execute one or more chanqe orders to the contract with west
Valley COnstruction Company, Inc., the value of which change
orders shall not e~ceed $69,784.50.
