Sidewalk Replacement Project_~ Award o~ Contract

This report recommends that Council award a contract in the amount
of $559,704~)7 to Ambo Engineering, Inc. for sidewalk repair and
replacement, curb and gutter replacement, and handicap ramp
construction at Alma Street and Meadow Drive. Funds have been
appropriated in P""u.blic 'Works Department, operations Division F'l
1991-92 operating budget,. C!P 1890) (Sidewalk RE::placement), CIP
47702 (Storm Drainage Enterprise F'--~:::!d), eIP 19073 (Major Inter
section Improvements), and FY 1991-92 Refuse Funa operating budget.
Discussion
Work under this contract includes sidevalk repair and replacement
in the area bOunded by Alma Street, MIddlefield Road, Lytton Avenue
and Hamilton Avenue 'Attachment A), curb and gutter replacement
throughout Palo Alto to correct drainage problems, installation of
handicap ramps at the Alma street/Meadow Drive intersection, and
construction of a concrete slab for recycling bins at the Recycling
Center.
Bids were received from 2 qualified contractors as sh~wn on the
attached S'llnlllary. staff recommends that the bid of $559,704.37,
submitted by Ambo Engineering, Inc., be determined by Council to be
the lO'Mest respons ible bid and that the contract be awarded
accordinqly. This bid is 1 percent above the engineer's estimatlE!
of $552,778.
This project is categorically exempt as defined by the California
Environment Quality Act.

by reference thereto:

k. Any and all supplemental agreements which amend or extend
the vorx contemplated and which may ~e required to complete
the ~ork in a substantial and acceptable manner.
J.. In consideration of such work .. CITY shall pay Contl'actor the amount
specified in his bid in the manner provided in said Standard
Specifications dated 1972, as amended.
-4 ~ Concurrently with the execution of this contract, Contractor shall
provide CI'lY with the Contractor's Labor and Xaterial and Fa.ithful
Performance Bonds and certificates of insurance, including any worKers'
compensation insurance required by the laws of the state of california
or othe~ise required in said specificatio~s.
5~ This contract shall not be assigned by Contractor.

COHTRACT (Continued)
All claims by Contractor regarding extra. work, charqes, delay or other
dispute.s Brisinq out of the Contract must be submitted to CITY in
writing within ten (10) working days after the claim arose, describing
in detail ~~e nature and value of the disputed vork or claim.
Contractor hereby agrees to indemnify, defend and hold harmless CITY,
ita cfficers, agents, and employees from any and all demands, claims or
liability Qf any nature, caused by or arising out of contractor's, its
officers', agen~s', or employees' negligent acts, errors, or omissions,
or willful misconduct, or conduct for which the law imposes strict
liability on Contractor in the perforl!lance, or failure to perform tl1is
AqreeDlent~
B. This Agreement represents the entire Agree~ent between the parties with
re.spect to the purchase and sale of the equipment, materials, or
supplies or payment tor services which may be the subject. of this
Contract. All prior agreements, representations, statements, negotia
tions and undertakings whether oral or written a~e superseded hereby.
9. No payment, partial paymant, ~cceptance, or partial acceptance by City
shall opers.te .1',6 'Waiver on the part of City of any of its rights under
this contract.
1". Contractor agrees to permit CITY: to audit, at any reasonable time curing
the term of this Agreement and for three (3) years thereafter,
Contractor's records pez-taining to matters covered by this Agreement.
Contractor further agrees to maintain such records for at least three
(3) years after the t~rm of this Agreement.
