CTP 18916 -Aw~rd of Contract Members of the Cvuncil: Report in Brief This report recommends that Council award a contract to J. C. SWenson Company, Inc. in the amour.t of $262,999 for the remodel of dormitory and restroom facilities at Fire statio~s 1, 3, and 5. FUnd~ have been appropriated in elP 18916, Fire Station Dormitory Mooiiications. Background This project will modify locker, bath and dormitory facilities in stations 1, 3, and 5. to provide privacy for male and female firefighters. On MaY 7, 1991, two bids ""ere received. Staff recommended that council reject a~~ bids due to insufficient funding in FY 90-91. The project was re-bid on July 2, 1991, and bids were received from three qualified contractors as sho'Wn on the attached summary ~ Staff recoIltillends that the base bid {lese deduct alterna"t.es) of $2~2,999, submitted by J. c. S~enson Company, Inc., be determined by Council to be the lowest responsible bid and that the contract be. a..,.-arded a~cc1.dingly. This;. bid is 20 percent above. the enqineer's estimate of $220,000. The cost of remodeling stations 1, 3 and 5 may leave insufficient funds for modifying the t'Wo remaining stations. If necessary, staff ~ill return during the FY 92-53 budget cycle with a reco~endation for funding modifications to stations :2 and 4. Recommendations Staff reco~~nds that Council: 1. Approve and authorize the Hayer to execute the attached construction contract with J. C. COB"l'RACT (Cont.in\.le5) All claims by Contractor regarding extra ~ork, charges, delay or other disputes arising out ot the Contract must be submitted to CITY in writing within ten (10) ~orkinq days after the claim arose, describing in detail the nature and value of the disputed work or claim~ Contractor hereby agrees to indemnify, defend and hold harmless CITY, its officers, agents, and employees from any and all demands, claims or liability of any nature, caused by or arising out of Ccntractor's, its officers', agants', or employees' negligent acts, errors, or omissions, or willful misconduct, or conduct for ..... hich the law imposes strict liability on contractor in the p,'!:rforzance ox failure to perform this Agreement~ This Agreement represents the entire ~qreement between the parties vith respect to the purchase and sale of the equipment, materials, or supplies or payment for services -which may be the subject of this Contract~ All prior agreements, representations, statements, negotia­ tions and undertakings whethe~ oral or written are superseded hereby. 9~ No payment, partial payment, acceptance, or partial acceptance by city shall operate as waiver on the part of City of any of its r~qhts under this contract. 10. Contractor agrees to penn it CI'ry to audit, at any reasonal::lle time during the term ot this Aqreement and for three (3) years thereafter, Contractor's records pertaining to matters covered by this Agreement.
