Resolution bpproving the Designation of the SQ~Haste Cpmmission
of Santa Clara CO:l.I.oty as Local Task Force Undee AS 939
Report in Brief
This report requests that council approve the attached resolution
(Attachment A) designating the Solid Waste COmll'.ission of santa
Clara Coun~y as the L~cal Task Fcrce Under AB 939 in place of the
Intergovernmental Cou~cil Solia Waste Committee.
On May ~O,. 1990, Council designated the-Intergovernmental council
solid Waste committee (CoInlllittee) as the Local Task Force under AB
939 (CMR:287: 0). On February 1.1, 1992, the Santa Clara county
Board of Supervisors established the Solid Waste Commission of
Santa Clara county (Commission) to replace the committee. Formal
adoption of this amendment requires approval by a majorIty of the
cities in Santa Clara County containing a majority of the
incorporated population.
Discussign
The attached resolution of the Board of supervisor$ of the County
of Santa Clara (Attachment B) approves establishment of the Solid
Waste Commission as the Local Task Force under AB 939. California
Public Resources Code section 40950 requires each county in the
State to convene a Local Task Force to assist in developing the
city and county source reduction and recycling ele~ents and
hou&ehold hazardous waste elements c-f the countywide integrated
waste management plan; to prepare the countywide siti~q element;
and to prepare other reports, plans and elements pursuant to the
Public Resources Code requirements. This aojustment in structure
will not ~ake significant changes in the role or functioning of the
Commission in the Santa elora county solid waste planning process4
Officials serving on the committee ~ill now serve as membeLs of the
Commission.

WHEREAS, section 40950 of the california P~blic Resources
Code requires e~ch county in the stat$: to CO:1vene a Loc~l Task
Fore"!. to ar.sist in deve.loping the city and county source reduction
and recycling elements of the countywide Integrated Waste
Management Plans prepared pursuant to ?W::lic Resources Code section
41000 at seq., ~o prepare the countywide siting ele~~nts required
pursuant to Public Resources Code sectioZ'", 4.1700 et seq., and to
prepare other reports, plans and elements as may be rc~~ired under
the Public Resources Code; and
'WHERE},S, section 40950 further requires that membership of
the Local TaSK Force shall bee determined by the county l::>oard of
supervisors and a majority of the cities within the particular
county 'Which contain a majority of the population in the county;
and
WHEREAS, the purpose of the Local 7ask Force is to ensure
a coordinated JJ:td cost-effective: regional recycling sJ.7 stem.. and to
develop goals, policies and procedures consistent lrfith guidelines
and regulations adopted by the state Integrated Waste Management
J3.oard; and
WHEREAS, in 1990 the Board of supervisors of Santa Clara
County (the RCounty") and th~ cities af the County established a
Local Task Force in conformance vith State requirements, namely the
Intergovernmental Council solid Waste Committee (the RCommittee");
and
WHEREAS, on February 11, 1992, the county Board of
Supervisors established the Solid Waste Commission of Santa Clara
County (the ""Camroission") and adopted a resolution to replace the
committee with the Commission as the County's Local Task Force#
which Commission shall asswtle all duties and responsibilities
previously assigned to the Committee;
NOW, THEREI='ORE# the Council of the City of Palo A.lt.o does
resolve as follows:
~IQ1L.l. The City council hereby finds that the adoption
of this Resolution is not a project for purposes of the California
Environmental Quality Act.
SEC1'ION 2. The City Council hereby approves and designates
the commission as the County's Local Task Force, required pursuant
to Public Resources Code section 40950.
