'1'his report provides council with two alternative rate str~ctures to achieve an average lC percent rate increase. The first alter-native; 'Which is the 5taff recommendation is a. "volume ne-'utral-(sometimes referred to as an inverted} pricing struct"olre. This arrangement charges the same rate per can. regardless ~f the number of cans. as opposed to the c~rrent pricing s~ructure .hich charge.s less per can as the number of cans increas8s. This alternative is in response to Councills direction last year during the budget hearings to chanqe the current refuse rate structure. The second al~er~ative is an across the board rate increase of 10 percent, applied to the current pricing structure~ This report also reco~~enda that Council approve and authorize the Mayor to execute an amendment to the compensation section of the existing contract ~ith Palo Alto sanitation co~pany (PASCO). Background The pre$ent contract between PASCO and the City provides for refuse collection services, operation of the Recycling center, operation of the curbside and comme.I"cial :Lec),cling programs, and the emptying and maintenance of trash receptacles located in various areas of the City, inclu~ing the University and Californi~ Avenue business districts. This contract provides a percentage of Refuse Fund revenue to be paid to PASCO fOT its services. The contract also allo~s annual renegotiation of this percentag~ in order to protect PASCO against escalatin9 costs ar.d to avoid excessive profits by PASCO. -1- O!lb 26 8 : 92 L ~ .. L . Source Reduction and Recl'clinq (SRRE) programs (AS 939). Projections Throuqt~L the Year 2000 Staff reviewed financial obli9ations for the Refuse Fund for fiscal years 1992-1993 through 1999-2000 to. e"timate the increase for hasic residential service (2 cans/back yard). This prOjection (Attachl::l.ent IIAN) WdS originally provided to Courlcil i~ October (CMR:439:91j as part of the long-te~ disposal agreement with Waste Management Incorporated (WMI) and has been updated to incorporate changes since October. The 10 year projections assume that the PASCO budget and the Refuse Fu.nd operating budgets increase at appro~imately 5 percent per year over the IO-year forecast~ Other impacts include the costs for lonq-term disposal (including PASCO's increased hauling costs) startinq in 1993. and implementation of Aa 939 programs. Ne~ programs and additional regulatory requirements, C't new refuse utility capital improve.ment projects .. ill require additional increases. Staff is recommending an average 10 percent rate increase for 1992-93; and is estimating a 30 percent increa$e will be required in 1993-514 to meet additional solid waste requirements, including hauling to a. transfer station site, disposal at Xirby Canyon land.fill in San Jose, and the closure fund for the landfill. Rate increases will be required in succeeding years and the actual pe~centage increase. will be determined each year during the budget process. In June 1988, council adopted a system improvement reserve (SIR) policy for the Refuse Fund (ClI1R:316:B). The SIR is to provide. funding for un budgeted and emergency expenses, ~nd is also used to smooth year-to-year fluctuations in Refuse Fund expenses. Finally, the increase ... ill finance capital improvements related to landfill operation and closure, including state required 15 to 30 year post-closure care. Volyme Based Rate~ucture Attachment "en is staff's recommendation for a revised utility rate structure ~hich proposes siqnificant changes to the ~urrent .y6~em structure~ The current rate structure charges less for additional cans, encouraging disposal of more solid waste; the proposed rate structure charqes the same amount per can, ~eqardless of the number of cans. Thus, the prcposed residential rate structure for-one can would be $11.00 per month (unchanqed from 1991), with each additional can $11.00. This proposed rate structure encourages source reduction and recycling for all cat~qc~ies of rate payers and will help the City to achieve the AS 939 goals ot solid ~aste reQuction .of 25 percent. by 1994 and 50 percent b:f 1999. The comparison belo'W shows examples of proposed rates. The one-can rate will not chanqe. Other categories will change more than 10 pgrcent, 'With high volume generators payinq as Ir,lJch as 51 percent more. Staff has contacted other jurisdictions and found that some solid waste entities hi!ve created a special category for a service of this type, and created a new service of ~mini-canw, or wsuper recyclerft~ The ~mini-canw cOl".tainer is usually 33-50 percent smaller than the standard container of 32 gallons. Staff feels it would be appropriate tc create a new category titled ~mini-can~, and offer this service starting in fiscal year 19~3-94. Staff wishes to delay this pzoposed new category until lII'9 }"I_ave the opportunity to assist businesses in the Palo Alto area £inding and stocking "mini" cans (approXiMately 20 gallons). Compepsation Amendment _to PASCO for Collection Services The collection contract pro~ides for a percent of refuse service billings revenu~ to be paid to PASCO for its services. City staff has carefully analyzed PASCO's cost data to project the operating cost requir~ments for FY 1992-93. For the purpose of rate settinq and PASCO profits, the pre-tax rate of return en undepreciated fixed assets is targeted at five percent. Any pre-tax profit exceeding eight percent will be divided equally ~ith the City. The City's share ~ill be credited against the succeeding year's revenue requirement for PASCO. If p~sco ~ere to receive more profit than the agreed rate of return in any particular f j seal year, the disallowed excess .,-ould be applied as an offset to next year's revenue requir~mentJ and the percentage of refuse service billing paid. to PASCO "Would be reduced~ This ensures against excessive prof~ts by PASCO. The percentege of revenue to be paid to PASCO will t~ decreased from 32.13 percent to 38,07 percent [or FY 1992-93. The reason for this is that the recommended rate increase _ill bring in apprcAimately $1.31 millio~ in additional revenues, most of which vill fund Refuse FUnd expenses, such as landfill rent. Enyironmental Assessment The California Environmental Quality Act (CEQA) coes not apply to the ~udifications to the refuse collection rates under the attached resolution, as set forth in C~lifornla public Resources Code section 210aO(b) (8).
