Amendment OrQinance and Consultant Agreement
MeMbers of the council:
Purpose Statement
This report recommends that Council app_t"ove an agreement with
Schinner Enqineering Corporation in the amount of $48,546, to
provide a survey of all City owned anQ Cit)--controlled leased
facilities for the Americans with Disabilities Act (ActJ
compliance. This report will provide the basis for the transition
plan required under the Act to be completed by July 26, 1992.
Staff also recommends that Council adopt a Budqet Amendment
Ordinance to e.stablish the project and fund "t"he site survey.
Further, staff requests that Council ..... aive the Policy and
Procedures 1-10 r~quirement pertaining to Finance Committee review
of consultant agreement$ over $20,000.
Background
In order to comply ... ith the recently enact~d Americans with
Disabilities Act, the city of Palo Alto must complete a transition
plan by July 26, .1992, detailing hO·iI/ it will cO!nply with the
requirements of the Act. Part of this plan includes bringing city
facilities into compliance with the Act. In Qrder to prepare the
transition plan, the facilities must first be surveyed to identify
all areas not in compliance.
Fou~ consultant firms were interviewed by a selection committee, in
accordance with the City's selection procedure for professional
Consultants. The firms interviewed were: CSS Associates;
Ehrlich/Rominger; MIG Incorporated; and Schirmer Engineering
corporation. The selection committee consisted of the City's ADA
Director, and staff from the Attorney's Office and from the
Facilities Management and Building Divisions. The committee
selected Schirmer Engineering Corporation as the top-ranking
candidate, based on the written and oral presentation t the ability
to perfo~ the work W'ithin the established time frame, and the
expertise aVailable within the firm related to the project.

The consultant ~ill ~e required to complete all survey ~ork and th~
final r~port~ including cost estimates, by June 26, 1992.
This project was not on the list of consultant agreements submitted
to the Finance Committee in July 1991, as the need for the project
was not known. Due to time constraints, it is essential that the
city rroc~ed with the project at this time. The transition plan
must be submitted to the Depart~ent ~f Justice by July 26, 1992.
Therefore, staff requests that Council waive the requirement for
yinance committee review ot this consul~ant selection.
Bepom:!!endations
staff reco~ends that COUncil:
1~ Adopt a Budget Amel'ldment Ordinance to establish the Americans

appropriate $55,546 from the Reserve. for capital Projects for
the project to fund the consultant surv~y.

consultant aq~eement with Schirmer Engineering Corporation in
the amount of $48 /546 for an ADA Conformance Survey of City

4. Authorize the City Manager or his designee to negotiate and
execute amendments for services related to or incidental to
the scope of work or services, t.~e total value of which
amendments shall not exceed $7,000.

AN ADOI~!ON~~ A?PROPRIATION FOR FACILITIES MANAG~MENT DIVISION OF
PUBLIC WOPKS FOR THE AMERICAN DISABILITIES ACT TRANSITION PLAN
WHEREAS, pursuant to the provisions of Section 12 of Article
III of the Charter of the city of Palo Alto, the Council on ~une
24, 1991 did adopt a bUdget for fiGcal year 1991-9~; and
WHEREAS. the

compliance; and

NOW, THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
~ION 1. The SUlP. of Fifty Five Thousand F'ive Hundred F..:lrty
Six Dcllars ($55,546) is hereby appropriated to Contract Services
in Facilities Management Division of the Public Works Department
and the Reserve for Capital projects is correspondingly reduced.
SEC'l'ION 2. This transaction will reduce the Reserve from
$5,454,695 to $5,399,149 as of March 31, 1992~
sECTION J~ The Council of the City of Palo Alto hereby finds
that the enactment of this ordinance is not a project under the
California Environmental Quality Act and, therefore~ nc environmen
tal impact assessment is necessary.

SECTION 6 -PAYl"IENT
