Oiscu5sion. Work under this contract includes sidewalk repair and replacement in the areas bound.ed by Miramonte Avenue, College Avenue, Park B~ulevard, and El Camino Real; and El Camino Real~ Williams Street, stanford Avenue, and california Avenue (Attachment A) ~ Bids were received from six qualified contractors as shown on the attached summary. Staff recommends that the bid of $443,131.67 1 submitted by Dolan Concrete Construction, be deter~ined by council to be the lowest responsible bid and that the contract be a~arded accordingly. This bid is 17 percent below the engineer's estimate of $531,579.35. This project is exempt from the california Environmental Quality Act. This Agreement represents the entire Agreement between th-e parties with respect to the purchase and saie of the equipment, materia is. or supplies or payment for serolices which may be the subject of this Contract. Alt prior agreements, representations, sta1elTlElnts, negotie-tiof'ls and undertakings whether oral or written are superseded hereby. No payment, partial payment. accep~ance, or partial acceptance by City shall operate as waiver on the part of City of any of its rights under this contract. Contractor agrees to permit CITY to aUdit, at any r~asonable time during the term of this Agreement and for three (3) years thereafter, Contractor~s records pertaining to maHers covered bV this Agreement. Contractor further agrees to maintain such records for at lea5t tf1re-e (3) years after the term of this Agreement.
