Report in Brief.
This report recomme.nds that Council approve Amendment No. 1 to
Consultant Agreement No. C59275 with Practicon AS50ciate$ in the
amount of $30,000 for Lucie stern Community Center Improvements.
Funds for this amendment are available from elP 18508.
Backgrounq
On June 28, 1990, Council approved an a9ree'rn~nt vith Practicon
Associates for ~124,994 to provide design and construction phase
services for Lucie stern Community Center Improvements (CMR: 390: 0) •
council also provided staff with chanq£ order autho~ity of up to
$12,500 for the cost of unforeseen modi~ications in the scope of
work. The project inVOlves installation of a heating and
ventilation system in the Community Theater and structural
reinforce:ent of Wing A of the Lucie Stern Center. A construction
contract for the project was awaraed by Council in May 1991
(CMR:248: 91),

The existing $12,500 change order authority has been depleted, due
to the nce<\ fer plan revisicr~s during the: construction phase.
Changes in the scope of work are not uncommon when dealing with
olde.r b'.lilo"ir.gs such as the Lucie stern Center. t>.ian revisions
resulted in staff issuing change orders to the consultant contract
fer the following:
I) existing heaters 'Were disci.lvered to have cracked heating
elements, requiring a replacement designi
• non-code wiring 'Was fO'J.nd 'When int.erior 'Walls we!"e removed,
necessitatiMg additional elec~rical design;
• termi te and dry rot damage became app,,-rent 'When e;:.::terior walls
were opened, causing building plan revisions;
• while installin~ air ducting. staff discovered an inadequate
basement wall requiring structural design.

As a result I staff recommends that Cou:1cil approve tne attached.
a.lIendmerrt to the agr-eel1l.ent, 'olIhich increases the additional 5/'\!rvices
by $~O/OOO from $10,000 to $30,000 tor tho following:
• a mechanical revleli of the contractor's heating .!f_nd
ventilation syst~~ changes and air balancing,
.;. 6.n archile-ctural review of the contractor's termite damage
repairs;
• a structural review of the contractor's wall repairs;
• an electrical review of the contractor's wiril".q I:lodificationsi
• design Qf additional access doors and walling for heaters in
the rehearsal and paint rooms; and
• desiqn of additional ventilation improveme'lts in the paint and
costUlllt! rooms ~
Based on the current schedule,; 'the project is expected to be
completed in the n~xt two months.

This project is categorically e~emp~ as defined by the California
Environmental Quality Act (CEQA) under Section 15301 of the CEQA
quidelines~
Regmpmendation
Staff recommends that Ccun~il approve and authorize the Hayor to
execu't.e the attached Amendment No. 1 to Consultant Agreement No.
C59:275 with Practicon Associates, in the amount of $30 I 000 for
additional consultant services related to the Lucie Stern Community
Center Improvements, CIP 18508.

cQvenants, the parties hereto agree as follows:
SECTION 1. Pa!'"agraph 7.1, ~ of Contract No. C59275 is
hereby amended to read as follo~s:

additiollal services, as aescribed in section 4 of this Agreement,

updated on January 1st of each year 'during the term of this
Agreement."
