GR!NT DEEP -CASTILLE~~_$CHOOL Members of the Council: Report ill Brief This report requests that council 1, adopt the attached Resolution declaring its intent to vacate a street easement on a portion of Melville Avenue between Bryant and Emerson Streets and 2) authorize the Mayor to sign the attached deed granting property to Castilleja School. Castilleja School is a priva'te educational facility located at 13:'0 Bryant Avenue (see Attachment .b.). Melville ~.venue runs through the campus, separating the main school parcel (Parcel A) from five smaller parcels, four of which are owned by Castilleja School (Parcels Al -A4), ~he remaining parcel is c~ned by the City of palo Alto (Parcel B). castilleja School is the owner of the land rights underlying the C2ty'S Melville Avenue street easement (riqht-af-way) bet ... een Bryant and FmersOfl, except for that portion of the easement ..... hich abuts the property at 211 Melville Avenue (Parcel C), a single family residential parcel owned by william L. and Paula Powar. In order to increase the area of the campus to allow for construction of an ~thletic field for their students, castilleja Schocl h~::: !"cquested that the City vacate its easement un the portion of Mel ville Avenue between Bryant and ELlers on streets. William L. and Paula Polltar, owners of Parcel C, have requested that the City vacate its easement on the pcrtion of Mf=lville Avenue that they own. This pOt"tion extends 30 feet out CMR:.l77:S2 . , from Parcel C's Melvil·l.e Avenue street side property line, to the c~nter line of Melville Avenue. The City of Palo Alto acquire1 Parcel B from castilleja School in 1972 as a part of the street closing project which made Melville Avenue into a cul-de-sac at Bryant Street. These app11cations were reviewed and reco~mended for approval by the Planning Commission on Februar:{ 14, 1992. The Planning Commission's recommenQations are scheduled f~r review by the City Cou:lcil prior to this item on the s~rne agenda on March 16, 1992. Vacation of Street Eas;em,ent In order for the City to vacate a street easement, the City Council must find that the easement is not necessary for present or pruspective public use and that there is public benefit ~Qsulti~g from th~ vacation. As a cul-de-sac, this portion of the Melville right-of-way is obviously not necessary for present or prospective public use by vehicular through traffic. With tht:O approval of the tentative map mergi.,g the individual parcels, there will be no parcels requiring this portion of the right-of ~ ..... ay [0,,-vehicular access. The public benefit from the vac~tion ..,ould ~esult from the reduced City maintenance costs for Melville Avenue. Parking CUXrgntly there are 30 on-street parKing spaces along the portion of Melville Avenue proposed for Vacation. The parking is mostly utilized by students, faculty and visitors to the schoeL As a part of its development application, CQstilleja Schoel proposes to provide fu:l compensatory park.ing for the displaced spaces, thus creating no impact to on-street parking. ped.e&trian ,'1nd Bicycle Use A public usage survey da'ted January 14, 1992, prepared by Eal::th Metrics InCorpQrated, lndicates a reasonable amount of pedestrian and bicycle through traffic utilizes the Melville right-of-way~ The report states: that on a typical ..... ·eekday between E a~m~ and 9 p4m.# the pedestrian and bicycle usage amounted to 39 personsj on the typical weekend day betwe~n 6 a.m a~d 9 p.rn., 52 persons. The average hourly public usage during this time period is one person approxim<"itely every 17 to 23 minutes. Therefore, a condi tioD of both the development project arld this eaS€1l1ent vacation is th"t Castilleja School yra~t the City a 12-foot ~ide access easem~nt for pedest.r ians and b icycl ~_sts frc;m Emerson Street to Bryant Street, along Melville Avenue. 211 Melville Avenue currently the single family property at 211 Melville Avenue (Parcel C) has a lot area of 7,500 square feet. The proposed eaSement vacation and the lot line adjustment ",·ould increase the size of the site to 10,500 square feet and thus increase the development potential of the property. The property line abutting Emerson js considered the front of the property, and vehicular access to the site is from Emerson Street. Therefore, the vacation of the right of-way would not affect access to the property.
