AItacbed for Council approval is a resolution amending the Merit S)"tem Rules and Regulations,
Chapter 10, Section 1002, "Causes tor Discip1inaty Action", in order to complete implementation
of the Department of Transportation Anti-Drug Program
In Apri1 1m, staff informed Counci1 (CMR:242:O) of the Department of Transportation'.
(D.O.T.) F"mal Rule: 49 CFR Part 199, Control of Drug Use in Natural Gas and Hazardous
Ugpid Pipeline Operations requiring gas distn"bution systems to implement an anti-drug program
including trainin8. testing. provision of an employee assistance program and a wrinen policy for
employees performing certain pipeline related functions.
We have me~ ronEeITed and reached agreement with Service Employoes' International Union
(S.E.LU.) regarding the impact of specific administr.tive procedures required to implement the
anti-<lmg program.
The implementation documents include an amendment to the City Merit Systems Rules and
Regulations to incorporate certain procedural violations as causes for discipliDaI)' action.
Attached 10 this report is • resolution amending Chapter 10, Section 1002 of the Merit System
Rules and Regulations to add u-.der Section 1002 a new subsection, "(y)" additional cause for
discipIiruuy aetion.
