Background In December 1989, Council approved an agreement 'With Santina and Thompson, Inc. to provide consulting services for imp~ovements at the Palo Alto Barbor. The improvements include restoring four acres of .arsh~ developing a marsh mitiqation bank, renovatinq the former Harbor Master's cottage, updatinq the Baylands Master Plan and constructinq a sailing station. On July 23, 1990 6 Council revie~ed the latest hydrological information provided by the consultant and directed staff to proceed with the detailed design of the sailing station. Piscllssion The consultant has recently completed a detailed technical evaluation ot the harbor improvements as part of the existing scope of work. Based on the evaluation, the San Francisco Bay Conservation and Development Commission staff has indicated to the City that 'Che harbor impr-ovements wi 11 require more extensive environmental review. This was not anticipated in the existing aqreement. Environmental documents ... ill need to be. prepared, requirinq a level of specialized knowledge and skill in bioloqica1 6 hydrological and soil sciences. After discussinq this matter with Planning Oepartment staff, it was concluded that the experience of Santina and Thompson in wetland projects would greatly assist staff in completing the environmental review in a timely manner and to tbe satisfaction of the regulatory agencies. The following represents the tasks to be performed by Santina and Thompson: -1- C!!R:581:0 ~. /"'. • 3 o o o Identify and solicl t the involvement of appropriate regulatory agencies and prepare a written environmental evaluation of the barbor improvements. o Prepare technical reports on the marsh restoration site which address the dredge spoils composition, as well as the drainage, hydrologic and biotic impacts on existing wildlife. o Prepare draft and fina.l environmental assessment documents incorporatinq co~ents from the City and regulatory agencies in a form suitable tor certification. Based on past experience with the requlatory e.qencies, statf assumed that any environmental issues could be resolved in writi~ or by telephone. Therefore, the scope of consultant work did not incluclli-meetinq .ith permitting agencies. Bo~ever, during the design phase~ the consultant unexpectedly discovered small a~ounts of hydro-carbons in the dredqe spoils which will be excavated as part of' the Darsh restoration. As IS result, the requlatory agencies now require that the City personally meet with agency representatives to review the laboratory testing reports for the dredqe spoils. In order to ensure that permittifl9 agency technical concerns are responded to in a timely and comprehensive fashion, it will be necessary for the consultant to attend those meetinqs with city staff. It is important that any outstanding issues be resolved quickly as the City is mandated by the San Francisco Bay conservation and Development Commissi~n to complete four acres of zarsh restoration by January 1, 1992. This requirement was macle under a previous permit which allowed yacht harbor dredqing. bQ.ompendation statf recommends that Council approve and authorize the Mayor to ex.~ute the attached Amendment No. 1 to Consultant Agreement No. C 55983 with santina and Thompson, Inc~. in the amount of $51,173, for additional services in the design phase of Palo Alto Harbor Improvements, elP 1891S.
