Background A project to seal an abandoned well located on the former ITT property was approved as part of the 1989-S0 CIP budget. The well is in disrepair and must be properly sealed in accordance with Santa Clara Valley Water District (SCVWD) regulations, in order to prevent potential groundwater contamination. On April 22, 1991, Council rejected all bids received on April 2, 1991 for this project, because contractors submitted their prices subject to several modifications to the contract documents (CMR:236:91). Staff agreed ~hat the modifications ~ould result in a clearer scope of work and therefore revised the project specifi­ cations to incorporate the changes before rebiddinq the project. Discussion On Hay 7, 1991, bids were recejved from two ~~alified contractors as shown on the attached summary. The lowest bidder was Maqqiora Bror. Drillinq, Inc., with a bid of ~~6,850. However, their bid wag subject to several modifications to the bid documents, similar tr the bids previously rejected by Council. For this reason, staff recommends that their bid be considered non-responsive and that it be rejected. Therefore, staff recommends that the second bid of $28,.98, submitted by Layne-western Company, Inc., be determined by Council to be the lowest responsible bid and that the contract be awarded accordingly. This bid is 6 percent above the engineer's estimate ot $27,000. -1- CMR:253:91 • / o o staff requests a 20 percent rather than the usual 15 percent construction contingency due to the uncertain field conditions that the contractor may encounter~ The level of difficulty of the worle is de.pendent upon the below-ground condition of the 'Well, wbich is unknown. Staff recommends that Council: L -Approve and. authorize the Kayor to execute the attached construction contract with Layne-Western Company, Inc. in the amount of $28,498 for sealing of an abandoned ~ell located on the tnrDer ITT property. 2.
