In addition to staff's comment. on the ordinance In the attached CMR, the Council "hould be aware of the following legal issues when considering the ordinance: 1. Regulation of Cpnsumption Y. Possession of Alcohol '1'he ordinance Ulends Palo Alto Huni<:ipal Code (·PAMC·) Chapter n. OC [Park Olle and Requlati ons) to ban the consumption, rather the possession (1.e. -ope.n container-). of alcohol in the City's paries. Under Article XX, section 22, of the California Constitution, the state (r.ther than the City) has the exclusive authority to regulate R2I§eslion of alcohol within the City.' Section 25620 provides that possession of an open container of alcohol in a city-owned park or other adjacent city-owned public place, or in any open .pace district, is prohibited if the city has enacted an ordinance Which prohibita consumption of alcohol in such areas~ Therefore~ with adoption of the ordinance, both the possession and consumption of alcohol in the City 1 8 parks Would effectively be prohibited. 2~ Alcohol Consumptipn in Parks-InfractiQn v, Misdemeanor The ordinance provides that anyone who consumes alcohol in a City park is quilty of an infraction. Most violation~ of the PAMC are misdemeanors, includinq violations of any ether-park regulations under Chapter 22~04~ such as the park closure require­ .. nts~ H0li9ver, violation of BUsiness; and Professions Code Section 25620 for possession of alcohol ia an infraction. Since it is easier to prove possession of an open container rather than actual consunption of alcohol, it is likely that .cst successful prosecu­ tions of the alcohol ban will occur under Section 25620 for possession, rather than under the PAMC provisions tor consumption. We therefore drafted the ordinance to be consistent with the state statute, so that both potential charges are punishable as infrac­ tions. No right to a jury trial or a public defender attaches to an individual charged with an infraction violation. Under Article XX, section 22 of the constitu­ tion, the city is not authorized to prohibit alcohol consumption where the state has already allowed it througb the alcoholic beverage sales licen:3ure process.J Therefore, tne ordinance prohibits consumption of alcohol within the park boundaries of the golf course, with the exception of the bar area in the restaurant which is currently licensed to sell and serve alcoholic beverages. 4. Park ClosurQ The ordinance requires that the City's parks close one hour a:fter sundown, with the. exception ot park buildings and liqhted areas which will still close at 10:30 p... At staff's request, the ordinance does not change PAMC section ~2.04.1S0(c), which qives the Director of community services the authority to set the openinq and closing time in Foothills Park. Should Council ~ere are, however, several related state statutes in effect that prohibit both alcohol consumption and possession. Under the california Business and Professions Code, Section 25662 prohibits possession of alcohol by .inors in public places (misdemeanor); section 25608 qenerally prohibits consumption end possession of alcoho ... on school property (misdemeanor).. Under the California Vehicle Code, section 23221 prohibits alcohol consumption in a vehicle upon a highway (infraction); Section 23222 prOhibits possession of an open container of alcohol while driving (infrac­ tion); Section 23223 prOhibits possession of an open container in a vehiCle upon a highway (infraction): and Section 23224 generally prohibits possession of alcohol In a vehicle if under 21 years of age (infraction) ..
