Membe~s of the Council: Report in Brief staff is recommendir~ Council adopt the attached proposed ordinance to amend the existing language in Title 17 of the Palo Alto Municipal Code {P~J(C} primarily to incorporate required state mandated provisions from AB 1030, ~hich became effective January 1, 1990. AS 1030 (Sher) amends Chapter 6~S of the California Health and Safet.y Code relative to underground storage tanks. Background Palo Alto Municipal Code Title 11, the Baza:.-d-ous Materials storage Ordinance 4 was adopted by Council in 1983 to regulate the storage and/or use of hazardous materials. The development of this model ordinance vas part of a Countywide effort to standardize hazardous materials regulations that qovern the use of Hazardous Mat~~ials or their processes. Since 1983 multiple laws have been enacted at the county. state and federal levels. AB 1030 attempts to make uniform those lawS regulating underground tanks, while allowing local jurisdictions to retain enforcement authority. Discussion The passage of PAMC Title 17 gave the primary responsibility of enforcement to the Palo Alto Fire Department for above and below ground storage tanks. With respect to underground tanks, certain language in Title 17 conflicts with and in some cases is 1 ••• restrictive than, the nev state la.... An example of where Title 17 is less restrictive compared to the state law would be the required replacement of all single ~all tanks that are not protected against spill or overfill ing by 199B. Another ~xample is that under state lay secondary containment ~ill be required of all pressurized fill lines by 1998. CUrrently, Title: 17 requires that only new installations satisfy these provisions. ellR 577;11 • To aaintain appropriate local .nforc.~.nt of und.r9round tanks~ the city .ust incorporate A8 10)0 prav!sio~. into Title 17 p~ior to January 1, 1~91. ~he proposed lanquage changes incorporat9 uinimu~ &tate require~ent$ and maintain our loc~l ~ur15dt~tion.
