Strert Resurfacing Project -Award of Contract

Report in Brief
This report recommends that Council a~ard a contract in the amount
of $209,991~05 to Fisk-Firenze-McLean, Inc. for street repairs and
resurfacing. Funds have been appropriated in the Public Works
Oepart~ent operations Divisjon operating budget for FY 199~-92.
Piscussion
Work under this contract consists of performing pavement repairs
and .overlay on 19 streets throughout Palo Alto (Attachll'lent AJ ..
',j,:hese streets were identified in the Pavement Maintenance
Management System as needing repairs to or replacement of
deteriorated surfaces.
Bids were received from five ql..1.ali.fied contractors as shoo,m on the
attached summary. staff reccmmends t~at the bid of $209,991.05 1
submitted by .Fisk-Firenze-McLean, Inc. ~ be determined by Council to
be the lowest responsible bid and that the contract be awarded
accordingly. This bid is three percent belo ... the engineer's
estimate of $217.091~
Environmental Assessment
This project is categorically exempt as defined by the California
Environmental Quality Act.
Recommendat ion
Staff recommends that Council:
1. Approve and authorize the Mayor to execute the attached
construction contract ~ith Fisk-Firenze-McLean. Inc. in the
amount of $20~.991.D5 for the Street Resurfacing project~

1. Contractor ahall do .all the work and furnish all the materials necessary
to construct end complete in a good, workmanlike and substantial manner,
and to the satisfaction of the
City of palo Alto, the following:
STREET RESURFACING PROJECT
2 ~ This contract shall consist of the followinq documents on tile. with the
city Clerk, all of Which are incorporated herein and made a part hereor
by reterenca thereto:

b. Notice Invitinq Sealed Proposals
c. Accepted Proposal
d. Standard Specifications dat.d 1972, as amended, or as
superseded by other documents incorpora.ted b,erein.
e. General Provisions
f. Technical Specifications --Special Provisions

h. Performance &ond
i~ ~bor and Materials Bond
j. Affirmative Action Cuidelines and CODpliance Raport
k. Any and all supplemental agreements which amend or extend
the ~ork contemplated and which may be required to cODplete
the work in a substantial and acceptable manner.
3 ~ In consideration of such work, CITY shall pay contra<:tor the amount
specifie4 in hi. bid in the manner provided in said Standard
Specifications dated 1972, as amended.
4. concurrently with the execution of Uis contract, Contractor shall
provide CITY 'With the Con'":ractor's L4bor and Material and Faithful
Perto~nce Bonds and certificates of insurance, including any workers'
co.pen.etlon insurance required by the laws of the State of California
or otherwise required in said specifications~

6. All claims by Contractor reqa~dinq extra wor~, charges, delay or other
dispute. arisill9 out of the Contract must be submitted to CITY in
writing within ten (lO) working days after the claim arose. describing
in detail the nature and value of the disputed work or claim~
7. contractor hereby agree. to indemnify, defend and hold harmless CITY~
its officer., agents, and employees ~rom any and all demands, claims or
liability o~ any "nature, caused by or ar!sir.q out o~ Contractor's, its
officers', agents', or employees' negligent acts, errors, or omissions,
or willful misconduct, Dr conduct for which the law imposes strict
liability on Contractor in the performance or failure to perform this
A!Jr ... ent.
8. Tbia Agre8l!!lent represents the entire Aqreement between the parties with
respect to the purchase and sale of the equipm.ent~ materials., or
supplies or payment. foZ' services whiCh may be the subject of this
contract. All prior agreements, representations, statements., negotia
t.ions and undlertaki1l9s whether oral or written are superseded hereby.
9. No payment, partial payment., aceeptance, or partial acceptance by City
shall operate .s waiver on the part of City ot any of its rights under
this contract ..
1-0. Contractor aqreea to persit CITY t.o audit, at any reasonable tise during
the terw of this Aqreement and for three (3) years thereafter,
Contractor'. records pertaining to matters COVered by this Aqreement.
