Report in Brief
This report recommends that Council award a contract to Echo West,
Inc. in the amount of $367,111 for construction of the structural
and heatinq/ventilation improvements in the Lucie stern Community
Center Wing A and the community Theatre. Funds have been
appropriated in Public Buildings Structural Improvements, elP
18508, and HeatingfVentilation at Lucie Stern, elP 18911.
BackgrQund
This is the last in a series of phased structural seismic
improvement projects at the Lucie Stern Community Center. Previous
phases included seismic retrofitting in the Children's and
Community Theatres, and the Recreation Division offices (Ruth stern
Wing and Wing B). The final pt • .J.se of work consists of
modifications to bring: Wing A and the community Theatre offices
into compliance with current building and seismic codes. Included
are the reinforcement of structural connections between the
bo..lilding walls at the .foundation and roof, rea~tachment of tiles to
the roof, and restoration of floors and walls affected by the work.
Also, heating/ventilation equipment will be installed in Wing A and
the theatre offices, and will be upgraded in the Community Theatre
auditorium.
Discussion
Bids yere received from 12 qualified contractors as shown on the
attached summary. Staff recommends that the bid of $367,111
submitted by Echo West, Inc. be determined by Council to be the
lowest responsible bid and that the contract be awarded
accordingly. This bid is 8 percent lOllisr than the engineer's
estimate of $4001000~
The planning for this project was done two years in advance and bas
been coordinated with the facility users. Community Theatre
presentations will be discontinued between August 1 and October 15,
1991, to allow for completion of all major construction in the

auditoriUD. Any work not completed by october 15 will be done
without disruption of the Theatre's productions.

Recommendations
sta~f recommends tha~ council:
1. Approve and authorize the Mayor to execute the attached
contract with Echo West, Inc. in the amount of $367,111 for
cons.truction of structural and heating/ventilation
improvements in the Lucie Stern Community Center Wing A and
the Community Theatre~
2. Authorize the City Manager or his designee to negotiate and
eyecute one or more change orders to the construction contract
with Echo West~ Inc. the value uf all of whieh change orders
shall not exceed $74,000.

J. In consideration of such "Work, CITY shall pay Contractor the amount
specified in his bid in the manner provided in said Standard
Specifications dated 1972, as amended.
4. Concurrently with the execution of this contract, Contractor shall
provide CIT¥" with the Contractor-'s Labor and Material and Faitnful
Performance Bonds and certificates of insurance, including any workers'
compensation insurance required by the laws of the State of California
or otherwise required in said specifications.
5. This contract shall not be assiqned by Contractor.

6. All claims by contractor regardinq extra York, charqes, delay or other
disputes ari.inq out of the Contract must be submitted to CITY' in
writing within ten (10J working d~ys after the claim arose, describing
in detail tha nature and value of the disputed work or claim.
7. Contractor hereby agrees to indemnify, defend and hold harmless CITY,
its officers, aqenta, and employees frcm any ana all demands, claims or
liability of any nature, caused by or arising out of Contr~ctor'S, its
officez~', agents', or employaes' negligent acts, errors, or omissions,
or wii: ful misconduct, or conduct. for which the law imposes strict

B. This Agreement represents the entire Agreement between the parties with
respect to the purchase ~nd sale ot the .equipment, materials,. or

9. No payment, partial payment, acceptance. or partial acceptance by City
shall operate as waiver on the part ot city of any of its rights under
this contract.
~O. Contractor agrees to permit CITY to audit, at any reasonable time during
the term of this Agreement and Lor three (3J years thereafter,
Contractor's records pertaining to matters covered by this Agreement.
COntractor further agrees to maintain such records for at least three
(3) years after the term of this Agreement.
