Hay 2, 1991 THE HONORABLE CITY COUNC!L Palo Alt~, California ,/ Landfill Security Fencing -Award of Contract Members of the Council: R@POrt in Br ie f 2 This report recommends that Council award a contract in the amount of $23,455 to Oaklanci Fence Company., Inc. for installation of security fencing at the Palo Alto Landfill. Funds are available in the Refuse Fund FY 90-91 operating budget. Discussion Work under this contract consists of constructing a chain 1 ink fence between the newly constructed Byxbee Park-Phase I and the active portion of the Landfill, as required hy state regulations. The six-toot-high, black PVC-clad fencing was approved by the Architectur~l Review Board on January 3, 1991. Bids yere received from nine qualified contractors as shown on the attached summary. The lowest bidder was Central Fe::"lce Ccmpany CCpe), with a bid of $17,150. However, due to an administrative oversight by CFC, its bid did not include pvc coatin9r yhich is required on all fencing mater ials4 Because of this substantial error, CFC has requested that its bid Le yithdrawn. Therefore. the City's Purchasing Division has detel..'Dllned the bid to he non­ responsive and has authorized staff to enter into a contract with the next lowest bidder. staff recommends that the bid of $23,455 submitted by Oakland Fence ~ompany, Inc., be determined by council to be the lowest responsible bid and that the contract be awarded accordinglY4 This bid is 36 percent below tbe engineer's estimate of $32,000. Environmental Assessment This project is categorically exempt as defined by the California Environmental Quality Act. -1- CMR:247:91 • -- o o Recommendations Statt recommends that Council: 1. Approve and authorize the Mayor to execute the attached construction contract with Oakland Fence company, Inc. in the amount of $23,455 for Landfill Security Fencing. 2. Authorize the city Manager or his desiqnee to negotiate and execut5!: one or more change orders to the construction contract with Oakland Fence Company, Inc., the value of all of which­ chanqe orders shall not exceed $3,500. Contractor shall do all the work and furnish all the materials necessary to construct and complete in a good, workmanlike ana substantial manner, and to the satisfaction of the City of Palo Alto, the following: Landfill Security Fencing 2. Aftirmative Action Guidelines and Compli~nce Report k~ Any and all supplemental agreements ~hich aroend or extend tbe ~ork contemplated and Which may be requlred to co~plete the vork in a substantial and acceptable ~anner~ 3 ~ In consideration of S\lch 'Work., CITY shall pay Contractor t.l).e a1rt0unt specified in his bid in tbe manner provided in said Sta!jQard Specifications dated 1972, as amended~ 4. concurrently with the execution of this contract, Contractor shall provide CITY with the Contr-ac:tor's Labor and Material and Faithful Performance Bonds and certificates of insurance, including any ~orkers' compensation insurance req~ired by the lays of the State ot California or otherwise required in $aid speCifications. 5. Contractor hereby agrees to indemnify# defend and hold harmless CITY, ita officers, agents, and amployees from any and all demands, claims or liability of any nature, caused by or arising out of Contractor's, its officers', aqent&', or employees I neqligent acts, er-rors, or-omissions, or willful misconduct, or conduct for which the law imposes strict liability on Contractor in the performance or failure to pertorm this AgYeement. 8. This Agreement represents the entire Agreament between the parties with respect to the purchase and sale of the equipment, lCaterials, or 6upplies or payment fer services 'Which may I;;.e the subject of t'his Contract. All prior agreements, representations, statements, negotia­ tions and undertakings whether oral or written are superseoeo hereby. 9~ No pa}~ent, partial payment, acceptance, or ~artial acceptance by City shall operate as waiver on the par~ of city of any of its right$ under this contract~ 10.
