By Resolution Number 6939 adopted on October-18,. 1990, the Council
declared weeds to be a nuisance, and ordered the abatement of that
nuisance as stated in Chapter B.08 of the Palo Alto Municipal Code. The
resolution provided for the hearing date of December 10, 1990, regarding
objections to the proposed destruction or the removal of these weeds, and
for interested property owners and ~embers of the public to be notified
of the hearinq.
Background
The County Fire Marshal's Office administers the contract for abatement
ot weeds within the City of Palo Alto~ Upon Jlotification of action by
the City Council, the Fire Marshal has taken the proper steps to notify
each property owner by aail of the contemplated weed abatement action on
respective properties and to pc"st in the council Chaml:lers a list of the
properties affected ~ The county Fire Marshal has fUrnished copies of the
property listing to the City Clerk and the City Fire Marshal.
At this public hearing. property owners may appear and object to the
proposed. weed destruction or removaL After the hearing and
consideration of the objections, the Council may allow or overrule any or
all objections. If objections are overruled, the Council is deeme~ to
have acquired jurisdiction to proceed: and the County will ~e asked to
perform the work of destruction and removal of weeds.

Staff recommends that Council adopt tbe attached Resolution ordering the
abatement of weeds.

RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
ORDERING WEED NUISANCE ABATED
~, this Council did on October lS, 1~90. adopt its
Resolution No~ 6939 declaring weeds to be a nuisanc~ and setting
December 10, 1990, at 7:30 F.E~, in the Civic Center as the time
and place for a bearing of objections to the proposed destruction
or removal of weeds; anc
WHEREAS, in llccort'jance 'With said Resolution, notice ef such
hearinq vas qiv~n in the mafuier provided by law, as appears from
the affidavits on tile in the Office of the city Clerk; and
WHEREAS, interested persons appeared or filed
written objections against said proceedings or any part thereof,
all persons desiring to be ~eard were qiven an opportunity to be
heard, and. all Il;stters and thinqs pertaining' to $aid 'Weed abatement
were fully beard and considered by this Council.
NOW t THEREFORE, the council of the City of Palo Alto does
hereby RESOLVE as follows:
SECTION 1. Any aTld all objections to the proposed
4estruction or =emoval of such weeds be, and each of them hereby
is, overruled.
SECTION 2~ The Fire Chief hereby is ordered to abate such
nuisance, or cause the same to be abated by ~eans of Contract No.
3120 for th&t purpose tdth the county of Santa Clar-a t and as
provided in Chapter 8.08 ~f the Palo Alto Municipal Code, and to do
all things necessary and authorized in said chapter.
SECTION ). This project 1s categorically exempt from the
provisions o~ the california Environ~ental Quality Act.
