Members of the Council:
Staff is prcposing ,hanges to the Architectural Re~ie~ Board (ARB) Ordinance,
as shown an the attached C~py of the proposed ordjnance. The purpose of the
changes are: 1) streamline the review process for relatfve~y minor propo~als,
saving the applicants' time and ~lim;nating unnecessary or duplicate efforts
by staff and the ARBj 2) adlieve tMe maximum beuefit from the Board's
expertise by using thelr valuable time for the review of proposals which have
l re1atively greater impact in tne community_
T~e proposed text cha~ges have th! effect of expanding the types of projects
w~ich (an be reviewed by staff to include: 1) all signs, if t~ey meet the
sign ordinance, and are consistent with any design guidelines adopt!d by th!
Boardj and: 2) minor'" changes to existing buildings, incTt.;ding minor additions,
if the change does not result in a Significant change in the appearance of the
building, and ;s consistent with design guidelines adopted by the BQard and
adopted by Council.
The proposed ordinance changes ~ere presented to the ARB at the December 5,
1991, ARB meet ing, and the Board member-s unanimo!..Jsly recoll111ended that they be
adaptec by City Council.
While the Planning Commission is not an official participant in the A~B
Ordinance process, the proposed changes were forwarded to the Commission
December 31, 1991, for their commer.ts and consideration. Commissioners were
asked to request that this item be agendized at their January 29, 1992,
meeting if they wished to discuss it, but ~o such requests ~ere made.

AMENDING SECTION 16.;8.050 OF CHAPTER 16 . .48
[ARCHITECTURAL REVIEW) OF THE PALO ALTO MUNICIPAL
CODE RELATING TO STAFF-APPROVED PROJECTS
The Council of the City of Palo Al to does ORDAIN as

SECTION L Section 16.48.050 of
[Architectural Revie~) of the Palo Alto Municipal
amended to read as follows:
Chapter 16.48
Code is hereby
16.48.050 Applicability of cbapter. No permit required
under Title 16 shall be issued except after approval of the design
of the proje~t ~y the director of planning and community
environment, or by the ci"ty council, as the case :may be, upon a
recommendation of the architectural review board, in compliance
with this chapter. The architectural rsview board shall make a
recorrunendation on the design of all of the follo"'ing projects:
(a) New construction, including publ ic
construction on public property. and including
exterior work and signs which require a permit from
excepting singly developed single-family dwellings
and additions thereto;
projects and

approval pursuant to Chapter 18.99, a PC zone
amendment thereto, applied for pursuant to Chapter

a PC zone: district shall initially be reviewed by the planning

plan shall be revie'Wed by tee architectural review board for
compliance with this cha.pter, and finally the developmer:t plan
shall be returned to the planning commission for a final
recommendation to the city council.
(2) In the event the planni~g commission, at its
initial review, recommends denial of the application, such
recommendation shall be forwarded directly to the city council, and
the architectural review board shall make no recommendation on the
application except as may be directed by the city council.
(3) In the event of inconsistencies in the
recommendation of the architectural revie .. · board on an PC

couunission and board shall attempt to resolve such inconsiste'ncies

chapter before final action ~y the city council.

recommendation shall be forwarded directly to t.he city counci 1, and
the architectural review board shall make no recomm~ndation on the
application except as may be directed by the city council.
(3) In the event of inconsistencies in the
reco-m:mendation of the planning commission and the recommendation of
the architectural review board, the cOmltlission and board. shall
atte.mpt to resolve such inconsistencies prior to for.rarding the
application to the city council by means which may include a joint
meeting. If the inconsistencies are not resolved, then the
separate recommendations of each body, together ~ith the minutes of
their respective :rr.eetings andior of the j oint meeting shall be
transmitted to the city council;

director of planning, and community environIilent may approve or
di6approve the design of a mino.!"' change to a project which has
previously received design approval without procuring a
recommendation of the architectural review board under the
following circumstances:

While reviewing these s~all projects, the director shall
follow the sa~e design quideline~ and record keeping procedures as
are generally required by the board ..... hen it reviews projects under
this chapter~ The director shall send a report, on a bia:1nual
basis, to the board concerning the number and type of p:--oj ect
approvals he ~r s~ makes under this section~ Not later than fDur
werking days afte:o:-the effective date of the director's decision
and action on a small project, any person aggrieved by the action
of the di~ector on the project may file a request for review of the
project by the board~ Under such circumstances, the bo~rd shall
review and make a recommendation on the design of the small project
in the same manner as it reviews and makes recommendations on other
projp-cts under this chapter. The same appeals procedure set forth
in sectior, Hi. 48.090 shall also apply too the small project.
SECTION 2. This is not a proj ect for purposes of the
California EnvironmentClil Quality Act ,IICEQAI!i).
SECTION_.d. This ordinance shall be effective on the thirty
first day after the date of its adoption.
