In addition, deteriorated walk ~rea~ around the playground equipment at Eleanor Pardee Park require replacement before they become a safety hazard~ A total of $2,600 is available for this work, ~hich ~as bid as Add Alternate 1. Qiscussion Bids were received from three qualified contractors as shown on the attached sllJDJIlUy. staff recommends that the bid of $38,950, includinq Add Alternates 1 and 2, submitted by savianb Company, Incorporated, be deterlllined by council to be the lovest. -responsible bid. ThiS bid is 11 percent beloW' the engineer's estimate of ~43,'5Q. Construction is scheduled to begin approximately May 1, 1991 and be completed by August, weather allowing. Approve and authorize the Mayor to execute the attached contrP:lct, includinq Add Alternate 1 and 2, with Saviano Company, Incorporated in the amount of $~8,950 for court and ~thway resurfacing and stripinq. 2.. Authorize the city Manager or his designee to naqotiate and execute one or more change orders to the construction contract with saviano Company, Incorporated the value of all of Which chanqe orders shall not exceed $5,900. Contractor hereby aqrees to indemnity ~ defend and hold harmless CITY, its officers, agents, and employees from any and all demands, claims or liability of any nature, caused by or arising out of Contractor's, its officers', agents~, or employees' negligent acts, errors~ or omissions, or willful :!lisconduct, or conduct tor 'Which the laW" imposes strict 1iaDility on Contractor in the performance or failure to perform this Agreeme.nt. 8.. Contractor aqrees to permit CITY to audit, at any reasona~le time during the term ot this Aqreement and tor three (3) years thereafter, Contractor~s records pertaining to matters covered by this Agreement. Contractor further aqrees to maintain such records for at least three (J) years after the term of this Aqreement.
