Background As a result of the public cont~oversy surrounding the placement of the sculpture -Fjarren Vaz:ren" at the corner of Embarcadero and Waverley Avenue, it became apparent to the Public Art commission that they needed to develop a clearly defined public process ~ith respect to their decision mak1nq regarding public art. The Commission has always provided an opportunity for the public to provide input, but the -Fjarren Vanner a controversy showed that the public was not always aware of when the Commission was going to make a decision. At their meeting of November 28, 1990, the Commission approved a public process policy (see attach~ent). The process includes the placement of advertise~ents in local newspapers, and notification by mail of residents. neighbors and businesses located within a 300 foot radius of the proposed site, as well as appropriate home­ owners' associations and special interest groups (e.g. Historical Resources Board). funding The attached policy requ~res that paid display advertisements be published regarding the placement ~f public art. To place display advertisements and to notify neighborhood residents by lIlail, additional funding ~ill be required to augment the Art in Pub~ic Places allocation. staff estimates that the additional funding CMR:211:91 April", 1991 Paqe b"o o -~~------- necessary .for display advertisements and mailing will be $1, 000 annually. The request for additional funding in the Art in Public Places program will be submitted for consideration as part of the FY 1991-92 CIP budget review process. In the meantime, staff will implement the recommended public input process and provide funds as needed from the FY 1990-91 budget. '. / PUBLIC PROCESS POLXCY DefiDitioD The Public Art commission is responsible for the final recommenda­ tion to the city Council regarding the Delection and placement of Art in PUblic Places, as well as providing relevant information to thl! public~ The Public Art commission will revielrt" and duly consider any and all public response. The Public Art commission 'Will notify the public of im.pending decisions concerning the installation of public art 'Works pursuant to the following process. 1. Public Art Commission acquires art in accordance with the eXisting Art In Public Places "Acquisitions Policies and Procedures .. 2.. Publish display advertisements reqarding the recommendation in local newpapers {subject to sufficient aoditional funding by the cit.y Council) .. 3. Notify appropriate residents and businesses by mail ~ including: a. Neiqhbors living within a 30(1 feet racUus of the proposed site b. Neighborhood homeowners' organizations near the site C. Obvious interest qroups, i.e., Historical Resources Board, environmental, ethnic... and s1 te users I qroups (sports .. retired) 4. Schedule a public hearing ~hen the Public Art Commission will discuss the proposed site and installation of art and reach a decision. 5.
