RESOWTION OF THE COUNCIL OF THE CITY OF PALO ALTO AKENDING RESOWTION NO. 6945 DECLARING ITS IN'EEN­ TION TO AMEND SECTION 12.16.020 OF CHAPTER 12.16 OF TITLE 12 OF THE PALO ALTO MUNICIPAL CODE BY ESTABLISHING UNOER5ROUND UTILITY DISTRICT ~~EP. 33 The Council of the City of Palo Alto does RESOLVE as follows: Resolution No. 6945 of this Council is hereby amended to read as tollows: SECTION 1. That in its opir.ion the. public necessity, bea~th and safety require, and that it is the lntention of said Council, pursuant to section 12 .. 16.040 of Title 12 of the Palo Alto Municipal Code., to amend Section 12.16.020 of said code., by order~ the establishment ot an Underground Utility District and to prohIbit the construction in and require the removal from said proposed district of all poles and overhead lines and associated overhead structures used or useful in supplying electric., C'.omI:luni­ cation or similar and associated services4 SECTIO~ 24 That the number of the pr~sed district ie Underground Utility District Number 33 of the Clty of Palo Alto, commonly known as Downtown Three. That the description of the area comprising said distri~ is as follows: All of the area in the co?"ty of Santa Clara., City of Palo Alto" encompass~nq the area bounded by Cowper street, Hamilton Avenue .. Webster Street, Lytton Avenue, Middlefield Road and Forest Avenue., all as more particularly descri~d on that certain map entitled -Downtown Three Underground Utility District Number 33,· on file in the office ot the City Clerk. SECTION 4. That from and after the effective date of the establishment of said proposed district., no person or utility sh-all erect or construct within said district any pole., overhead lines or associated overnead structu['"e used or useful in supplying electric, communication or similar associated services. SECTION 5. That vithin ninety (90) days from the date of the eOEpletion and acce~tanc~ of the proposed underground facili­ ties within said distrIct to be eor.~tructed by the city of Palo Alto and the Pacific Bell Company, all pole.s and overhead li.nes and associated structures used or useful in supplying electric, communic~tion or similar and associated services in said proposed district ahall be removeC!, and from and after said date no person or utility shall use or .aintain such facilities 'Within said proposed district.
