This report requests Council approval of a ta:n-year lease ac;reement
between Three Hundred BAlIilt"" Associates (Lessor) an<1 the city of
palo Alto (L.ssee) tor 9,144 .quare feet of office space at 300
HUliltor. Avenue, Palo Alto, california to acc:::CJmOdate 35 members of
the Utilities Department ataft.

During the 199a-91 budget process, council approved funds tor the
twelve additional peraanent employees to the utilities staff over
a three-year period as part of the process to upqrade. and repair
the city's infrastructure systam, and a lease of office space to
accoJUlodate the •• addition~l Itaff mambers. As discussed durinq
the 19S0-91 budget process (CMR:282:0), space at the Civic Center
1. currently well over optimal limits on virtually all floors, so
t~at the additional .taff will requir~ the lease of new space and
the reorganization of currant spac.~ Consequently, Council
approved statt'. reC01llZlendatlon to lease approxi.ately 9,000 square
feet in the downtown area to aova approximately 30 members of the
utilities Departaent .taff.
Ourinq the last eight month., staff from ~~e Real Property Division
and Utilities Department htis vieV$d twelve different facilities and
rejected all but ~ee gt theae facilities as possible locations
for the utiliti •• engineering .t.tf. There ar~ two main require
zents tor the location:

In November, .talt selectad one of the remainlnq thr~a locations as
ita primary location. Ale ••• &9reement with the first location
vas being prepared to present to council, but the existing tenant
decided to retain occupancy. Staff turned its attention to the
second and third locations, 20' and. 300 Ham,ilton Avenue. Both
.ltea aUbmitted ofter.~ 300 Ha.ilton yaa chosen over 209 Hamilton
becau •• it aet the City's need. with a smaller lease area, and it
is closer to city Hall and, thereby, easier for public access.

The l~~se provides for 9,14~ square teet of office apace, Which
include. allot the fourth floor and the easterly halt of the fifth
floor. The lease rate of $3.10 per square foot includes janitorial
servicas l taxes I insu~ance and • build-out cost of $85,000. The
lease rate is COlIIIparable to other lea.sed. sites providir19 .cull
service provisions. The lea •• al.o includes a five-year ¢ption at
~5 Fercent of the then market rat_. A summary of the major lease
previsions (Exhibit A) is attached to the proposed ten-year lease.
