The project consists of constructing an apprQ~tmately 15-acre seasDnal fresh
wat.er marsh lisirliJ about one mi1lion gallons per day of reclaimed water from
the Palo Alto Regional Water Quality Control Plant and to enhance an existing
salt marsh on 152 acreS of City-owned property in the Baylands known as t"e In site.
This report also recommends approval of the attached Park Improvement
Ordinance and a Resolution authorizing the Cit), Manager or ~is aesignee to
execute an agreem~rlt with the State Lands C.ommissl0n.
~ackground
An envj~onmental assessment was prepared, and a mitigated negative declaration
for the project w.s adopted by the City Councilor, July 24, 1989. Tnis step
was taken ahead of the Sit~ and Design review process because t~e California
Coastal Conservancy required environmental reVl€W prio~ to their decision on
funding. On August 7, 1989, the City COLlnCn authorized th~ Mayor to sed::
California Coast"l (or,servancy funding and to enter into a contractual
agrE'ement. He Cit), succassfu11y pursued funding from the California Coastal
ro~servancy and a contractual agreement for the full amount of the ar.ti~ipat~d
design and construction costs (51.2 mtllion) was finaljzed on November 3,
1989.
Pla~n;ng Commissiqn Action
The Planning Commission, at its meeting of January 30, 1991, voted undnimo~sly
(7-0) to recommend that the City Council approve the site a~ld design
appl icatfon for 2601 East Bayshore Road (fermer 1TT property/Palo Al to
Baylands) subject to thi;-foliowing findings and conditions. Minor (hanges to
the conditions of apprc¥al as retommended by the Planning CommisSion and any
additional conditions of approval reccOOI€na'ed by the Planning Corrrnisslon are
reflEcted in italics.

agreed to enter i~to a lease -.itn the State Lands. Commission which cannot be
enf~rced by the State unTess they can issert legal jurisdiction over the site.

not affect any of the ownership rights of the City. Ti'1erefore, staff

3. The proposed desigrl \rjnl ob~en:e st:H.md principles of emlironmental
design and ecological balance since con!truction will b~ limited to
facilitles necessary to conduct needed water onto and off the project
site, in t"'at the project ;s designed to pr-ollide f-or bot~ a freshwater
habitat and a saltwater hahitat.
4. The proposed project is consistent with t~e existing permltted la~d-uses
in the Palo Alto Comprehensive Plan and' the 8aylands Master Plan, in
that the project slte 1S desig~ated OpEn Spa~e/Ccntrol1ed Development i~
the Comprehens.ive Plan, and ·is designated as Manh iil the Baylands
Master Plan as well as meeting the Master Plan's Site specific goals and
objectives.
Conditions.
1. All plans and spt!cifications for the project shall be subject to rHiew
and appro~il of City staff prier to construction.
2. All construction acti~itles snall be subject to compliance with the
provisions of the City's Noise Ordinance (Chapter 3.1D of the Palo Alta
Municipal Code).
3. The construction contract shall provide for dust control measures as
required by the CHj's PIJbTic Works Department.
4. The project sh~ll be subject to a11 applicable conditions of approval of
the local, state and federal p~rmit applications.
5. The project shan campl1 with all mitigation measures and monitoring
requirements contained in the mitigated Negaths Declaration p!"'epared
for ti1is project (89--EIA~1!t attached) to the satisfaction of the Public
Works Department.
6. The project shall comply with all additional monitoring requirements
which IItdy be identified by state and federal agencies during the1r final
r~~iew of the project.
7. Signi shall return for final Architectl.:ral Rev1ew Board approval prior
to installation of the signs.
8. The constr"ctian contract shall provide for the imposition af a monetuy
penal!J against the contractor of Ii specific sum to be stipl.JJlted in the

APPROVING AND ADOPTING THE ITT MARSH ENHANCEMENT
PLAN (PALO ALTO BAYLANDS)
WHEREAS, Article VIII of the Charter of the City of Palo
Alto and section 22.08.005 of th~ Palo Alto Municipal Code req~ire
that before any substantial puilding, ccnstr~cticn, reconstruction
or development is COI!'l.menced or approved, upon or with respect to
any land held by the city for park purposes, the Council shall
first cause to be prepared and by ordinance a~prove and adopt a
plan therefor; and
WHEREAS, on July 24, 1983 the City Council approved in
concept a Marsh Enh3ncement Plan for construction of facilities to
create a ~reshwater marsh and to enhance an existing salt marsh ~n
1'52 acres of city-o...,ned property in the Baylands fonnerly owned by
ITT (the ·project"); and
WHEREAS, on November J, 1989, the California Coastal
Conservancy agreed to fund the design and construction of the
project: and
WHEREAS, James Montgomery 1:.ngineers has pt:epared R. plan fot:
the project entitled "City of Palo Alto Design Report --Palo Alto
ITT Marsh Enha~cement Plan, December, 1990" (the ·Plan"): and
WHEREAS, the Plan hilS been reviewed and recommended for
approval by the Arc:hitect'.Jral Review Bcar-d and the Planning
Commission pursuant to Chapter 18.82 of the Palo Alto Municipal
Code (Site and Design Review) ~ and
WHEREAS, the Cour.cil desires to approve the Plan and to
adopt it as the official plan for th.c construction of improvements
to the ITT Karsh portion of the P~lo Alto Ba~lands;
NOW, 'l'HEREFOR£, the council of the city of Palo Alto does
ORDAIN as follows:
SECTION 1. The Plan, a copy of which is on file in the
Public Works Department, and to ~hich copy reference is hereby ~ade
concerning the :full particulars thereof, is hereby approved and
a(!opted.
SEctION 2. The city council, on July 24, 1989, approved a
Mitigated Negative Declaration for the project and hereby finds
that no further ~nvironmental assessment is required.

REGARDING THE ITT MARSH ENHANCEMENT PROJECT
WHEREAS I the State of Ca1ifornia, th~ouqh the State ~nds
co:cu:nission, has ass.erted j~ri.sdiction over ce::-tain tidal lands
located in the City of Palo Alto, including the I'l'T Marsh and "'~as
demanded tha~ t~e City e~ter into a l~ase agreement with the State
for such property, 3S a condi tir.J~~ to the Stat.e' 5 approval of the
Cityts Marsh Enhancement Project; anj
WHEREAS I th~ city cf Palo Alto dispute5 the State's
asserted jurisdiction l ar.d belie .... es that the lands are the sole
property of the City of Palo Alto: and
WHEREAS, because resolution of the respective rights of 'the
state and city could be costly a~d time consu~ing~ the Stat~ has
agreed to modify its general lease agreement to acknowledge that
its riqhts have not been legally co,.,!j rmed, and to refrain from
enforcing the lease except only as to lands Which may be Bultimate
ly confirmed into State ownership~; and
WHEREAS, in order to proceed with the Marsh E~ancement
proje~t ~ithout undue and costly delay, the city Council desires to
enter into the modi f ied lea.3e agreement 'With the State Lands
Commission.
NOW, THEREFORE, the Council of the City of Palo Alto does
hereby resolve as follows:

city of Palo Alto and the State of California., acting by and

The tft! began consideration of releasing reclaimed water to tne former ITT
property in the early 19805 is • result of suggestions from the State Regional
Water Quality ContrGl Board to find an 11ternat~ discharge location~ The
Regional Water Quality Control Board indicated that discha'ge through the
Ustorfc wetlands would increase the "'benefichl uses· in the South Bay by
providing enhanced wildlife habitat and reduc1r.g pollutant loading at the
existing discharge locatiofi. Use of as much is one-third of the ~egiona1
Water Quality Control Plant's ~5 million-gallon-per-d.y (HGO) iloo oas
considered. Howe~er, it was d~termined that the Pale Alto flood Bas;~ COUld
not rece1ve reclaimed water of that magnitude w1th~ut diminishing its flood
control capability. Therefore, t~e project was staTed back to approximately
HGD of reclaimed water.
It was also determined that at least one ~ndlnge~ed species~ t~e salt ~irsh
harvest mouse, 1 ived on a pot'tion of He fOnler rn property. Tne rll:!cTiiimed
water is fresh (as opposed to salt water) and cannot be used on that portion
of the property. To enha.nce the mouse's habitat, salt water from tile Sili
should be .llowed to flow to the eastern side of t~e property IS it did p~ior
to 192i.

I have received my copy of the ITT Marsh Enhancement Plan prepared
by J~~ Consulting Engineers Inc~ When I was first contacted by M~.
John C. Gibbs of the Water Treatment Plant, who I understand is no
longer in city employ. we discussed the flooding of the salt water
sloughs and the effect it would have on our 2 monocone antennas.
please refer to section 5, figure 5-6 of the enhancement plan. In the
center of the page you vill notice 2 ciLcles, which are our 2 mono
cone antennas. These antennas have A 360 degree groundinq array that
lay flat on the 5u£face of the earth directly below the antennas.
I discussed my concern wit~ MI. Gibbs that when the sloughs were
inundate~ ~ith salt ~ater, if any overflow ~curred, the salt water
would have a deterio.ating effect on the 9round plane, connections
and Coax ceble buried ben~ath the ground. Mr. Gibb5 assured me that
in the planning stage, they vou!d plan on having berms made around
the antennas to preclade any overflow from the sloygh.
I am unable to find any mention of this in the enhancement plan and
therefore am concerned that ~hi~ has been overlooked in the planning
stage.
