Purpose Statement

This re.port recommends that Council award a three-year contract, in
an amount not to exceed $475,000 per year, to Davey Tree Surgery
Company for trimming trees near electrical lines. Funds have been
appropriated in the Public Works Department Operations Division FY
1990-91 operating budget for year one of the contract. Fundinq for
years two and three is contingent upon Council approval ~f t.he
budgets for each year.
BackgrQund
The t.rimming of trees near electrical lines in front and rear
easements is performed year-rounc1 to prevent inte~ruption of power.
Services are contracted in two ~ays: unit line clearing (based on
price per t.ree) in areas of the City identified by staff. and
hourly (price. per crew hour) for unscheduled or emergency line
elearinq. COmbining these t~o types of labor provides efficiency
and flexibility ot service to the City. Approximately 2~080 to
C~16-0 crew hours per year may be contl'"acted, depending on the. price
bid fGr unit trimming.

This contract was bid for three years, which is advantaqeous to the
City. Staff has found that contractors bid lower prices when they
are able. to amortize. Klaj·or equipment over a multi-year period. In
addition, efficiency and quality of worle. increase when the
contractor's employees are hired for longer periods of time and
become fa3iliar yith the areas and tasks.
The 10\l'est responsible bi~er for this work is deter.ined by
combining the total unit pri.ce bid per contract year and the hourly
crew rate bid, times C~160 crew hours per contract year.. The
actual crew hours will vary each year, dependinq on the amount bid
for unit price trimming and unsched·uled or emergency tl: imaing
required.

Bids were received trOll three qualified contractors as shown on the
attached summary. staft recommends that tbe Davey Tree Surgery
COlIlpany bid of $1,288,022 for the scheduled unit: price line
clearinq and: $SSll J 343 for the unscheduled hcUrly line clearing
(ba.ed on 4,160 hours) fGr a total of $1~879.165 for three years be
deter.ined by Council to be the lowest responsible bid, and that
the contract be awarded accordingly. The contract will not exceed
$475,Oc)Ct par year (hourly worlc would be reduced to stay within the
budqeted amount).
Recommendat.ion
staff recommends that Council approve and authorize the Mayor to
execute the attacbed three-year contract, in an amount not to
exceed $475,000 per year. to Davey Tree Surqery Company for
electrical line clearing.

Specifications dated 1912, as amended.
4. COncurrently with the execution of this c~'tract, Contractcr sha11
~ovlde clty with the Contractor's labor and material and faithful
performance bonds and certificate.s of insurance required. in said
speCification.

5. All clal.s by Contractor regarding extra work, charges, delay or other
disputes arisinq out of the A9ree~ent must be submitted to City in
writing within ten (10) workinq days after the claim arose, describiD9
in detail the nature and value of the disputed work or claiB.
7. The contractor bereby agrees to indemnify. defend and bold harmless
the City, its officers, agents and employees from any and all demands I
claims or liability of any nature causee! by or arisi1l9 out of
contractor'. neqligent acts, errors. or ODlssions. or willful
.I.conduct, or conduct for which the law i~poses strict liability on
