This report requests Council approval of three Resolutions ordering:
the summary Vacation of Public Service Easements for utilities
located at: 4151-4197 Baker Street" 525 Geo·rqia Avenue; 320-350
Duluth circlei 17C~ Guinda street~
4151-'197 B~kex street and 525 Georgia Avenue:
The property owner has l-equested that the Cit} .. vacate the 10-foot
vide Public Utility Easement (PUE) 'Which runs along the rear
property line of the properties on the north side of Saker Avenue
[see map attached to F.esolutionJ a This easement was included among
those assigned to the city of Palo Alto by Pacific Gas , Electric
company in the 1970's, when Barr~n Park was anne~ed to the City.
However, there are no facilities located within the easement, and
it is not necessary for any present or future use.
320-350 Dulut_ Circle:
The property O'JD.er at 320 Duluth Circle has requested that the City
vacate a lo-foot wide storm drainage easement running along the
common property line bet~een 320 and 350 Duluth Circle {see map
attached: to Resolution). The storm drain vas relocated to a
development behind 320-350 Duluth Circle and the storD drainage
easement on these properties has become surplus.

The property owner at 170,0 Guinda street has requested that t~.e
city vZI.cate a portion of a 5-foot 'Wide util ity easement (see map
attached to Resolution). The pole line for 'Which the easement 'Was
acquired has been moved to a different location on the property;
however, the recorded easement 'Was not changed to match the new
location. In order to. correct this, the City will vacate the
surplus portion of the easement and the owner will grant the City
a new easement f~r the relocated pole line. The map attached to
the Resolution shows the portion of the easement to be vacated and
the new easement to be obtained and rec~rded.
Vacation of tbe EI,emeats
The attached Resolutions will vacate the above described easements
under the provisions of the Calif~rnia streets and Hi9b~ays Code
'Which allows for summary vacation of public service easements .. hieh
have not been used for five consecutive years or more, o-r .. here the
utilities have been relocated, and which are no longer necessary
for present or future use.
EpTironmeDtal Review
These projects are categorically exemp~ from the requirements of
the California Environmental Quality Act; therefore I no environ
mental impact assessment is necessary.
Staff recommends that the Council adopt the three attached
Resolutions of the Council of the city of Palo Alto Ordering the
Summary Vacation of the Public service Easements for, respectively:
1. utilities at 4151-4197 Baker street,
Avenuei
2. A storm drain at. J20-15-Q Duluth Circle; and
.)~ utilities at 170-0 Guinda street.

FOR UTILITIES AT 17~O GUINDA STREET
nEREM, a pole line has been relocated at 170,0 Guinda Street in Palo Alto;
and as a result-l no other facilities are located within a portion of an
existing easement; and
WHEREAS, from all evidence submitted to the Council of the city of Palo Alto
it is found that· said public service easement as described herein is not
necessary ror present or prospective public use for public utility purposes;
and
WHEREAS, it is the intent of the Council of the City of Palo Alto to vacate
a poction of the public service easement for the utilities recorded Feb~ary
24. 1936 in Book.l of Haps at Page 17~ in the City of Palo Alto, county of
Santa Clara. state of California; and
WHEREAS. the Council of the city of Palo Alto intends to vacate such public
service easement according to the procedures set forth in California Streets
and Highways Code Division 9, Part ~I Chapter 4 (section 83]3 et seq.);
NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as fo110..5:
