This is an information item and no. council action is required
or recommended.
on Ju'ne 25,. 1990-, the Council approved the Housill9 Element of
the Comprehensive Plan. The adoption of the element included
modifications tor Programs 9 and 12 related to the provision
of Below Market Rate (SMR} units in residential projects in
multiple-family zones. At the time of consIderation by
council, and in order not to unfairly penalize current
applicants, staff indicated that the old regulations would
apply to any project currently being revieWed by the Planning
Department.
In applying the new regulations for BMR bouslnq, staff will
use an application cutoff date ot August 1, 1990. Any new
residential project of three or more units located in a
multiple-family zone~ that has had submitted an application
submitted to the Planning Oivision prior to August 1, 1990,
will be subject to the old requlatipns~ This includes
applications tor ARB preliminary review~ In order to bave a
sunset clause for all projects , final design approval of a
substantially conforming project, must be Obtained by August
1, 1991.
Through copies of this information report and through
telephone calls. staff has notified project developers and
appli~nts known to be preparing development monitoring
applications that .1ght be affecte~ by the chanqe in
requlatlona ~
