Palo Alto, California

ordinance Requiring Recycling of Auto Air Conditioning Fluids
$t;j!!It~s Report
Xembers of the Council:
This Is an informational re.port and no Council action Is . .requested
at this time.
The Council, on November 13# 1989, directed the City Attorney to
prepare an ordinance ~ich would require service statIons and auto
repair shops to capture and recycle air conditioning fluids
containIng chlorofluorocarbons (CFCs}. The Council direction was
in response to a request from the City's advisory Task Force on
CFCs, which recommended that the ordinance take effect on July I,
1990. The ~rpcse of this report is to explain the status of the
ordinanoe as vell as related legislatIve and regulatory activities
at the state and ~ederal level.
Background
Chlorofluorocarbons are amonq the manmade chemicals which, when
they migrate to. the earth's stratosphere ... deplete the pro·tective.
laye.r of ozone which abields the earth from Ultraviolet radiation.
High levels of ultravIolet radiation cause a number of significant
health and environmental effects~ including increased incidence of
skin cancer.. (stratospheric ozone should not be confused with
qround-level ozone, a constituent of smoq.)
currently, 'When mobile (autos and trucks) and commercial air
conditioning: \nd refrigeration units are serviced, refrigerants
containi~ CFCs are often released into the air, threatening the
ozone layer. The refrIgerant In mobile air conditioners accounts
for aore of these chemical releases than any other American source.
CFC-l2'" the refrigerant used in mobile air conditioners Coften
referred to as Freon). has an atmospheric lifetime of more than 120
y.ara~
The O.S. Environmental Protection Aqency estimates that
approximately 63 pe.rcent of total CFC use in the United States
occurs in industries 'Where recyc11n<J is possible. These industries
inelude: mobile air conditioning (21.3 percent of total use);

chillers ('.S percent), coamercial refrigeration (16.9 percent),
solvent cl.anlnq (14.2 percent), sterilization (5.1 percent), and
hou •• bold refrlqeratlon (1.2 percent). ('Chillers' are air
conditi~ninq systems in commercial and industrial buildinqs.)
Refrigerant recyclinq equipment bas recently come on the market
which enables aechanica to pull the refrigerant troll the air
conditioner into a holding tank and filter it. Refrigerant
properly treatec5; in this manner is cl.an enouqh for re.use in
automobIle air conditioner.~ Refriqerant recycled by machines
certified by a qualified testinq laboratory, ouch as Underwriters
Laboratories (UL), Is acceptable for new car warrantiesa
Recycling caMot be expE::cted to capture all CFCs which would
otherwise be released from mobile air conditioners. It is
estimated that anywhere froD 30 percent to 50 percent are
inadvertently rele.asedi from leaky air conditioners while the
vehicles are in operation.
Progr.gs to pote
Tbe City Attorney has prepared a preliminary draft of an ordina~e
which would require any person in Palo Alto Who repairs, services,
.alntalns, or disposes of automotive air conditioners to capture
and: recycle. air eonditloninq fluids containing CFCs. Tbe owner or
operator of the service facility would be required to certify that
an approved recycling system. Is available ana 1s being used by
properly trained personnel. Staff has proposed that verification
would be handled by the Fire Department as part of its regular
Inspection program. In April, staff Bent a letter describing the
proposed ordinance to 96 Palo Alto firms whicb bad been identified
as auto-related buslne •• es. (Staff has not Burveyed each fira~ to
deteralne if eacb actually performs air-oonditloninq work.) staff
asked the recipients to comment on the liipecific requirements of the
ordinance, 8uch as effectIve date, availability of equipment, and
access to training and certlflcatl~.
To date. responses have been received from ten businesses.
Generally, those who represented new car dealers indicated that
they already own the equipment or have it on order. Their concerns
were Vbether the City's requlre~ents might be [ncompatlble with
their current procedures. The other respondents, While agreeing
with the environmental importance of preventing the release of
CFCa, expressed several concerns about the equity of imposing such
requirements on the businesses in one city while businesses
elsewhere would be unaftected.

Staff h .. oleo contacted othor jur.!a,UcUons in California known to
have enaoted ordinances sImIlar to that proposed in Palo Alto. The
city of San Joae 1 s ordinanee~ which became effective July 1, 1990,
requires all persons .ervicing, repaIring, or dismantling
automotlve air conditioners to obtain an annual perait for the use
of an approved recycllnq system. The ordinance also prohibits the
.. 1. of the small containers of Fraon, frequently used by -do it
youRelters.· San Jose 1. alloving a two-to-three months grace
period before begInninq any attempt to verify compliance with the
ordinance. Applicants will be issued a permit if they can produce
a purchase order sbowing that they have placed an order for the
recyclinq equipment.
In August 1989 the City of Irvine adopted a comprehensive ordinance
qovernlnq the manufacture. distribution, sale and recycling of
products which utilize ozone-depletinq compcunds and created the
position of Environmental Proqra. Coordinator who is responsible
for the administration and enforcement of the ordinance provisions.
'!'be requir .... ent that air conditioninq fluids must be cap~ured and
recycled in. accordance with a recycli.nq system approved by the.
Environmental Program Coordinator became effective July 1. 1990.
About one-third ot the affected businesses have applied for the
require~ permit which is valid for three years~ Enforcement bas
not begun because there Is a lengthy backlog on orders placed for
rec:ycllnq equipment.. Th.e. Environmental Proqram Coordinator Is
currently devoting a great deal of tize tOo educating t.he auto
repair busInesses about the. benefits of the recyclIng liystem,~ as
well as making the public aware of the program and the
participatinq businesses.
on July 16, 1990, the Sonoma city council adopted an ordinance
wblch~ When effective, will require recycling of ozone-depletIng
compounds used In any refrigeration and/or air-conditioning units.
The SOnoma City Council acknowledged t.hat the ordinance would have
limited impact on the environment unless duplicated on a regional
basis and therefore viewed the ordinance as a policy statement. A
clause within the ordinance provides that enforcement shall be
d~ferred until such time as the County of Sonoma adopts a similar
ordinance.
Despite pre •• reports to the contrary, the City of Berleeley has not
adopted an ordinance requirinq CFe. recyclinq. Prelillinary
discussion has occurred and the iasu~ .ay be sched·uled tor a
council hearinq in OCtober 1990.
Bl.ewhere in the united States, the city ot Denver, Color3do, has
a~ted an ordinance wIth provisions .imllar to those of San Jose,
but. those provisions shall not become effective until January 1,

1991.. The City of Jrrewark, NeW" Jersey, has a(5.opted a comprehensive
ordinancs very .i.llar to that of Irvine. Its provi51ons became
.ffective in phases between November 1ge9 and April 1990. The State
of Vermont baa enacted leqislation WhIch requires the recycling of
.obIla air conditioninq fluids aftor January 1, 1991.
Action pending at the fe~eral Lev.l
"!'he Montreal Protocol on Substance. that Deplete the OZone Layer,
an international treaty .igned In 1987 that haa now been ratIfied
by the United: states and 51 other nations and Which became
effective. January 1, 1ge9" calla tor red·uctions in the productlon l
Importation and exportation of CFCs to tHty percent of the
lIorldwide 1986 levels by 1998. In the interill, the Protocol
imposes a current freeze in production of eFes at the 1986 level
and calla for a twenty percent redaction from the 1986 level by
199J.
R~c.nt scientific discoveries have shown that the reduction l~vels
.et forth in the Kontreal Protocol may be InSUfficient to remedy
the qlobal bea~,th and safety risk created by the release of CFCs"
and several nations are calling tor a total phaseout of production
by the year 20'00. ThIs issue i. beinq addressed in Congress. The
Senate and the House of Representatives have passed differing
versions of The 1990 Clean AIr Act which are presently in a
conference committee. The Bouse version would require the
altaination of domestic production of cres by 1997 which Is three
years earlIer than the senate version. Furthermore, rene90tiation
of the Montreal Protcool hos bequn.
EVen if prod, uction of CFCs ceases by the year 20'00, 0'. So.
EnvIronmental Protection Aqenoy (EPA) analyoi. ehows that the rate
of chlorine loadings to the stratosphere will COf'ltlnue to increase.
However, it Is likely that d.laye~ or reduced release of CFCs d~e
to recyclinq over the next thirty to forty years will lower the
peak of chlorine concentratl~'.
On May 1.. 1990 the EPA Issued an Advance Notice of Proposed
Rulemaklnq, invitll19 comments by July 2, 1990 on the development of
a national program for recycling ozone depleting compounds. To
achieve. the xontreal Protocol commitment, the EPA intends to
promote cost-effective approacbes that will ensure an orderly
transition to substitute cbemIcals and alternative technoloqies.
The Advance Notice anticipates that the EPA's first priority, if a
regulatory approach is adopted, w~ld be to target the mobile air
conditioning and I5tationary re.friqeration and air conditioning
industry because of the large amount of eDissions recoverable, the
rapId advancement of recycling technoloqy in tho .Ob11e air
conditioning industry, and the efforts already underway by the
prIvate .ector and state and local requlatory agencIes.

Tho Advance Noti .. " otated that the EPA belioves that tha technology
end equipment e~i.t which make it technically fea.ible to require
the recovery, recycling .. and reuse of mobile air conditio-ner
refrigerant by January 1, 1992. The EPA is considering a federol
regulation which would pha •• in .andatory recycling based on shop
aiz.. Large corporationa and: industry trade qroups are already
actively promoUIl9 recyclill9, but the community of independent
•• nlce technicians may not yet see the economio bene.fit ot
recycllnq.. However.. the value of recycling eres w11l become
evident .a the supply of virg1n CFCs decreases and the cost ana
axel •• taK~S placed thereon increas.s ..
If EPA regulatIons are a~te~ .. the Adv&nce Notice indicates such
U!I"lations would probably includ" certlficatiC>tl otandards for
racycling equipment and for the training of air conditioning
service technicians. An important rationale for establishing
federal requlatIons Is the concern that independent. action by
.tates and local governments could result in varying standards and
program requirements. (It a:boulc:l be noted, however .. that the
pending Clear. Air Act cf 1990 discussed above contains a provision
that the Lederal qover~e.nt may not preempt enact31ent .of more
stringent state or local CEC requirements.) The Advance Notice
also requested comments on whether the compliance and enforcement
features of a mandatory recycling progr&ll should be a federal
responsibilIty, a state responsibilIty. or a joint proqraa bet~een
the states and the federal government.
Action Pending at the state Level
Assembly Bill 2532 (Vasconcellos) woulcl require the ue~ of
refrigerant recycling equIpment approvecl by the State Bureau of
Automotive Repair In the. &ervicltl9 of vehicle air conditioners
having CFC ref.rigerants. 'I'he Bureau would be required to establish
and administer procedures for insta.llation end use of the recycling
equipment. The bill would prohlbit the sale of Freon in containers
smaller than 15 pound_. Ths bill has additional provisions dealing
with tbe Bale and tran5fer of new and used motor vehicles with CFC
baaed air conditioners and the. installation and servicing of
commercial and: industrial refrlqeratlon systems.. The bill's
requirements related to. mobile. air conditione.rs would become.
effective Janua.ry 1 .. 1992. The most recent text of AB 2532, as
nended July 6" 19-90, Is attached~ The blll has passed tbe
Assembly and is currently in the. senate Appropriations Committee ..
State legislatIve staff who are monitoring AS 2532 expect th.t it
will pass both houses of the Leqi.l~ture this session but cannot
predict what the Governor's action viII be.

Onder A8 25J2~ the requir ... nt tor recycling refrigerant would not
take effect as quickly as the Palo Alto City Council bad directed,
but it would result In unifora requirement. statevide and uniform
standards for equipment and certification. Absent the state
le\llslatlon, the City is unable to call upon the Bureau of
Autoaotive Repair to specify equipment standards and requirements
for training and certification.
Stat-Initiatiye
Appearing on the NOVember 1990 ballot will be proposition 128, The
Environmental Protec~lon Act of 1990, popularly referred to as the
"5i<;, Green" iniUative. Among the many provisions of this
comprehensive measure i. one which would require, no later than
January 1, 1993, the maxi .... WI feasible recovery and. recycling of
CFCs <suring the servicing or disposal of any air conditioning and
refriqeration .ys.tems and appliances, ine1udinq vehicular air
conditioners. By January 1~ 1993, the Bureau of Automotive Repair
shall establisb and adJIinioter a proqram mandating the installation
and proper use of approved refrigerant recycling equipment by any
person who services vehicular air conditioners and Rnforclng the
usa of that equipment. The initiative would also prohibit the
.anufacture or sale of any CFCs in containers of less than 15
pounds.
Conclusion
ActiOl"ls are pend.inq at the state and federal level Which would
require the recycling of refriqerant in .... Obil. air conditioners.
These actions are not apt to become effective until January 1 .. 1992
at the .arllest~ but they would result In the establlshmen~ and
enforcement of unito~ standards tor operation and equipment.
onless Council directs othervise, staft vBl deloy bringing the
proposed local ordinance to Council for consideration until after
the November 6, 1990 qeneral election. At that time, it will be
known whether A8 2532 has been enacted into law and/or Whether the
voters have approved PropositIon 12B. ~he timetable tor adoption
of regulation. by the V. S. Enviroruaental Protection Agency may also
be knovn by that time.
By delaying Council consideration of the local ordinance, the City
.. y avoid the expense and staff ti:me required for notification ..
edueat1on.. monitorIng and enforcement, if these tasks are to be
aubaequently taken on by state and/or federal aqancles.

Staff believe. that local firm. whieh .ervice .obile air
conditioners will Boon lequire recycling equipment even if an
ordinance locally onforcing it i. not adopted at this tIme. The
expectation that refrigerant recycling vill eventually be mandated
at the .tate or federal level ia becoming widespread, coupled wIth
the knovledqe that CFCs are being phs sed out. Businesses vill see
the economic advantages of capturing and recyclill9 their own supply
ot CFC refrigerant, as the cost of virgin ere refriqerant rises and
the quantIty produced diminishes.. I:ncreas.inq consumer awareness of
the importance of avoiding the relea •• of CFCs into the air will
support use cf the recycUng equipment as well.
