cultural Center Boiler Installation -Avard of Qontraet
Members of the Council:
This report. recommends that Council award a contract to Western
Allied service Company in the amount of $38,48).75 to install a new
boIler at the CUltural Centera Funds have been appropriated in the
Public Works Department Facilities Management Division FY 1990-91
operating budget.
Background
The boiler which provides heat for the Cultural center is over 30
years old and is worn out. A new boiler will meet operational
requirements and will have increased energy efficIency.
Piscusslon
Bids were received trom four qualified contractors as shown on the
attached summary.. St.aff recommends that the bid of $38,,483.75,..
subDitted by western Allied service Company" be determinec1 by
council to be the lowest responsible ~id and that the contract be
awarded accordingly. This bid 1s ( percent above the engineer IS
estImate of $37,,000.
Recommendat ion II
staff recomJDends that Council:
1.. Approve and authorize the Mayor to execute the attacbed
construction contract with western Allied Service Company in
the amount of $38,,483.75 tor installation of II. new boiler at
the Cultural Center.
2.. Authorize the City Manager or his designee to neqctiate and
execute one or more change orders to the construction contract

In consideration of such vork, City shall pay Cont~actor the
amount specified in his bid in the manner provided in said
Standard Specifications dated 1972, as amended.
Concurrently with the execution of this contract, Contractor
shall provide City vith the Contractor's Labor and Material
and Faithful PertOrKlance Bonds and certificates .of insurance"
including any worker's compensat.ion insurance required by the
laws of the stat.e of California or otherwise required in said
specIfications ..

All claims by Contractor reqarding extra work, charqes, delay

Contractor hereby agrees to indemnify, defend and hold
bar-less City, Its otfic.rs~ agents, employees from any and
all demands, claIms or liability of any nature, caused by or
arising out of Contractor'., its officers', agentsl or
employees' negligent acts, errors, or omissions. or willful
miscond·uct, or condu-ct for yh.!cb. the laW' imposes strict
liability on Contractor in the performance or nonperformance
of this Agreement.
This Agreement represents the entire Aqreement bet~een the
parties with respect to the purchase and sale of the
equipment, materials, or supplies or payment for services
'Wbich may be the subject of this COlltract. All prior
a9reements" representations, statements, negotIations and
undertakings whether oral or written are 5upersece~ hereby.
