THE HONORABLE CIT~ COUNCIL
Palo Alto, California
saD fTancisguito Creek Erosion Control, CIP 47702 -Additional
compensation Authority
Members of the Council:
This report recommends that council authorize aOditicnal
compensation auth¢rity to Agreement C56231 with the Santa Clara
Valley Water District (District) in the amount of $111 .. 888 for
erosion control measures along San Francisquito Creek~ Funds are
available in elP 47702, Collection System Improvementsa
Background
On July 10, 1989, Cou-neil approved an agreement between the
District and the City for erosion control measures along San
Francisquito Creek between Alma and Emerson Stre.ets.. Periodic
erosion control measures are necessary to protect the east bank
adjacent to Palo Alto Avenue. If left uncontrolled, erosion 'Would
eventually threaten the stability of Palo Alto Avenue and other
public improvements wbich lie adjacent to and beneath Palo Alto
Avenue~ Past control measures have utilized sacked concrete, which
is the most effective" least cost method available for erosion
control of high steep embankments ~~ich are commonly found along
the creek. Sacked concrete" however" is no~ visually compatible
with a natural creek envirorunent. As a result, staff and the
District have since explored alternative methods and found that,
for this project, qabions (large rocks enclosed in wire baskets)
could be used instead of sacked concrete. Gabions, although more
costly than sacked concrete" preserve the natural creek environment
as the wire baskets will be seeded for re-vegetation.
Discussion
Under the current agreement, Petlo Altors 5·0 percent share oE the
total estimated cost of the project is sun .. 5·0'0. As indicated in
the attached letter from the District" the cost has increased by
$111,888 from $187,5·0,0 to $299,,388 due primarily to specifying
gab ions rather than concrete sacking in the bidding documents. The
increased cost also results from approximately 10~ feet of
aciditio4al slope protecti~n for erosion ~hich has occurred since
approval of the agreement and from seeding for re-veqetation. The

aqreement calls for adjusting Palo Altos share based upon actual
bids received~
The. District has performed all design and is responsible for
pertoraing the contract eaninistration. No substantial changes in
the scope of work which raise the total cost of the project will be
made during construction unless the District rece lves prior-written
approval from the City. The City's Public Works inspector will
monitor all construction to ensure compliance ~ith all Palo Alto
standards. The project ~ill he completed by the end of the summer.
Environmental Assessment
The agreement states that the District will act as lead agency for
compliance with all applicable envi~onmental laws and regulations~
including: the California En .... ironmental Quality Act. Palo Alto will
act as a responsible agency for purposes of the Act.
Recommendations
Staff recommends that council:
1. Authorize additior.al compensation auth~rity to Agreement
C562J1 with the santa Clara Valley Water DistrIct~ in the
amount of $111,888, for erosion control m£asures alor~ San
Francisqulto Creek.
2. Increase the City Manager's or his designee's authority to
negotiate and execute one or ~ore additional amendments to
Agreement C562J1 with the Santa Clara Valley Water District
for additional services related to., or incidental to., the
scope of work or services the value of all of 'Which amendments
shall net exceed $17 ~ 000.. This represents an increase in
staff's authority from $29 .. 000 to $45,0 1010 for all amendments.
