California Source Reduction And Recycling Element of AS$embly Bill 939 - consultant Agreement Members of the Council: This report recOmlrlends that Council approve an agreement with Emcon AssocIat.es in the. amount of $111,80:0 for con&ulting services tor the preparation of the Source Reduction and. Recycling Ele.ment (SRRE) of Assembly Bill 939 wbich has been incorporated into emergencY' requlation:; by the California Integ-rated Waste Management Board. Funds have been appropriated in the Refuse FUnd FY 1989-90 operating budget .for the initial work required" and staff has b\ldqeted $150,,0(1'0-in the 1990-91 Refuse Fund operatinq budget t.o co~plete the vork. sac'kground Legislation which became effective on January 1, 1990 requires all cities and counties to prepare and submit a 5RRE which proposes proqrams to reduce or recycle 25 percent of all solid waste currently landfilled by 1995, and SO percent reducti~n by the year 20<1'0. Work under this agreement consists of the review and compil ation of existing information, a waste characterization study, and developing new programs to meet the mandated goals of 25 and 50 percent.. The consultant will prepare the plans and programs consistent with applicable regulatIons and viII assist the City in the submittal and approval pr-ocess with the appropriate regulatory aqencies. Discussion AS 939 regulations require each City to prepare 6 adopt and submit to the County, on or before July l~ 1991 6 a source reduction and recyclIng element which includes the following components: o Waste Characterization o SOUrce Re(j·uetio-r'l. o Recycling o COlIlpostin<] o Special Waste o Household Hazardous Waste o Edu~ation and Public Information -1- • . \ \. \ \ \ ~ \" '.,.-.. ~, .>~. :" i:., . - o 0 o Oi5posal Facility Capacity o Fundi"9 o Integ-ration Tbe priority for reduction is (1) source reduction; (2) recycling and composting: (3) environmentally safe transformation; and (4) environmentally safe land disposal (as the last option). AB 939 allows eities to undertake joint waste characterization studies. H01rIever. tl"le requlations clearly indicate that each participatlnq city is responsible tor identifyinq (in its SRRE) the quantity of solid waste within its jurisdiction~ unless tva cities can d~monstrate they have the same ~lation. number of residential qarbaqe accou·nts (single family and multi-family) and commercial accounts within 10 percent. staff has been working with the Countyw'ide Technical Advisory COmmittee (TAC) on solId waste to l~plement the SRRE portion of AB 939. In order to determine the llIost cost-effective method. to complete the SRRE4' Public Works Department staff has requested conSUltants to discuss in their proposals the advantages and disadvantages of the city jointly undertaking the SRRE with two or lI'Iore cities4' including the potential cost savings and the city staff time required for admInistratIon and coordinati_o.n .of this contract .. Responses from consultants are summarized as follows: Advantages o Common study methodology and data analysis o Consistent regional approach to waste composition study design o Common data bas~ for waste diversion information o Framework for future cooperation among cities in meeting SOl id Waste Management goals o Strong ~es~age of cooperation among the ~ommunities involved~ Disadvantages o o Loss of total control by the City over the project4' and scheduling and financial conflicts. Delay in t.he implementation of the SRRE due to the added complexity of conSidering all the jurisdictions~ Cost Sayings o Waste Characteri~at!on component Minillal savings can be expected in performing the 'Wa.ste generation study with other jurisdictions because (1) virtually all the waste qenerated within the City is disposed at the Palo Alto landfill; (2) little waste from outside the City is disposed a'; the landfill; and (3) the city hauler -2- CMR:384:G • \ \ \ . \ \ .,. \" ;., . ; ... p , " - . -_. o serves only Palo Alto~ The regulations and instruction tro~ the california Integrated Waste Management Board are clear that the study must seqregate and determine the waste stream which comes from each city. o SR.'U: o Al tt.ougb the SAAE Is city-specific" some savings can be realized by the city in cooperating jointly in preparing the SRRi: since the required verbiage and information is -boilerplate-that may be utilized in preparing more than one element. savings are proportional to the number of jurisdIctions that cooperate in SRRE Preparation. City Staff Time Required for Administration and Coordination of this Contract 20 to 2S percent of City's Project Manager is required throughout ti1.e duration of the project (12 to 14 months] .. More staf£ time is required if more than one staff person is involved in reviewing the draft components. Total staff effort required will be the equivalent of one third to one balf of a full-time perscn year. Staff has .valuated the advantages and disadvantages of a joint venture, and recommends that the City of Palo Alto should prepare its own SRRE. Of major concern with a multi-city appr-oach is the time required to prepare a joint RFP and qo through the consultant review and selection process vith other communities. This would resul t in the completion date of the SRRE extending beyond the mandatory submittal dates specified in AS 939. Ot.her factors ... including the variatIon in vaste streams between cities and the concern that a joint report. could result in the dilution of quality in the end prod,u-ct. that is specific to Palo Alto, 'Would detract frOll. the value and applicability of the report for Palo Alto's needs. Proposals ~ere receiv~d from seven environmental -consulting firms. Consultant firms ~ere interviewed by an advisory committee consisting of staff from the Public Works Department's Operations Division and the Finance Department ... in accordance with the city's selection procedure for professional -consultants. TWo firms met staff requirements, but subsequent negotiations on the proposed fees 'With one of the proposers vere unsuccessful. staff felt the other firm's experience, its ab:lity to meet the criteria established in the proposal, and the tees relative to the se=vices to be provided were more consistent with estimates on the proposed fees. The committee selected Emcon Associates based on the evalo.aticn. -3- CHR:JSC:O • \ " , , "'- t, I , ! \ , \ \ \ . \ --' i I l . .;. . o o The project ~as not included in the list of FY 1989-90 consultant work submitted to the Finance and Public Works Committee in July 1989. The bill was passed in the last legislative session in December 1989, ar~ became effective January 1, 1990. Attachment A specifies mandated dates tor completion of the cityls SRRE. Staff requests that Council ~aive the review of this agreement ~y the Fina.nce and Public Works committee wbich 'Would allow staff to complete the work within tbe time frame established by the state. ReOQmme nd at ions staff recommends that Council: 1. Approve and authorize the xayor to execute the attached consultant agreement with Emcon Associates in the amount of $111,800 for consulting services for the preparation of a source reducticn and recycling: element fer Palo Alto. 2. Authorize the City Mana~er or his desl;nee to negotiate and execute amendments for servIces related to or-incidental to the scope of work or services,. the value of all of which amendments shall not exceed $16,700.
