CA 94303-0862 Dear Mr~ Gilliland; 7 June 1990 Followinq review of the Draft Environmental Impact Report for the 340.0 HillvieW" Avenue-redevelopment I have come to the conclusion that inadequate pro·tection exists to ensure a thorough cleanup of the release of hazardous materials trom the site~ The 3400 facility is involved with two separate imminent and substantial endangerment orders from the state Department of Health Services (DRSJ. The first order concerns the clean~p of materials released from the site and is know as a site specific order. The second order is known as the Hillview-Porter regional order and involves the 3400 facility along with five other facilities in the area. In orde~ to insure that the 3400 facility properly fulfills their obligations under these orders I would suggest a condition of the building and use permit to include that the 3400 facility remain in compliance ~ith both or these oLders~ I strongly believe that such a condition is the only effective ~ethod to insure that the 3~OO qroup fulfills its stat~tory obligations. FurtherMore I agree vith the Bay Area Air Quality Manage~ent District in their recommendation that the reconstruction of the property only be allo~ed following the remediation of toxic contaminants present at the site. Finally I believe that the DHS sbould provide documentation that the facility is or is not in compliance with these orders at various stages of the redevelopment and if the site sbocld qo into none compliance all ~ork ~ould balt. Staff requested the preparation of a focused Environmental Impact Report as a supplement to the citywide Land Use and Transportation Study in order to address four speci~ic areas of concern distinctive to this site: 1) the additional traffic and transportation impacts that could be addressed on an interim basis until adoption and implementation of th~ Golden Triangle regulatIons and stanford Transportation Demand Management (TOM} program; 2) clean-up of hazardous materials from the existing site; 3) the visual and aesth~tic considerations due to the site location and topography; and 41 the impacts on cultural resources. specifically the adjacent archeological site. ~Y~S~I~SL-______________ _ PROJECT DESCRIPTION: The proposed project is the redevelopment of a 16.3-acre site in the Stanford Research Park. The project consists of the development of 20·6.0'O'O-square-feet of office uses related to research and development wbich ~ould replace the exist.ing 9:l .. 0<l'O-square-foot ind·ustrial fa.cility on the site. Access to the site vi}l be from the t~o eXisting drive~ays from Foothill Expressway and Hillview Avenue. The new buildings ~ill be located in the same general area as the existing buildings ~ith additional parking areas being added to the western portion of the site. Five two-sto~ buildings are arranged in a campus setting on the eastern balf oE the siter Total site coverage is 14.7 percent ... ith an FAR of O.291~ The two buildings facing Foothill Expressway ~ould be set back JG/1990/A/PC3400HI 2 ! i [ i I I I , I , ~r ; o approximately 100 teet from the roadway, while the bulldinq faci"9 Hillview Avenue would be set back approximately 200 feet. Parking for 6 .. ., cars 'a'ill be provided with landscape reserve parking for an additional 13 cars~ BACKGROUND: The propose~ design yes reviewed by the ARB on a preli.inary basis on September 216 1989. The ARE was very supportive of the project, particularly the site plan. The ARB expressed .inor concerns related to the need for more substance in the design of the building walls. Minutes of the meeting are attached. The project has been reviewed and approved by Stanford University with only minor concerns related to design of the exterior ~alls and landscaping. These items will be aQdressed at the ARB meeting:. ISSUES OF CONCERN: The primary issues of concern are covered in the DEIR ~hicb found that all impacts can be mitigated to a less than significant level. except fo~ cumUlative traffic impacts and air quality impacts as previocsly stated in the Citywide Land Use and Transportation Study~ These impacts are mitiqated for this project through the payment of the traffic impact fee adopted as a part of the Citywide study~ The following are the primary issues addressed in the DEJR: 1. Traffic circulation impacts: The Citywide Land Use and Transportation Study addressed the impacts of full build out of the Stanford Research Park. As a resolt of that study, a traffic impact fee is imposed to mitigate the cumulative effects of the.added square footage~ The Foo,thill Express.,ay/Billview Avenue intersection is identified for improvements to be made from the traffic impact tees~ The applicant has also proposed an interim TDM Program to encourage ride-sharinq, van pool parking~ bicycle use. and on-site amenities. In addition the prospective tenants will be Subject to the stanford Research Park TOM Program when adopted • .2. Baz~rdous Materials Impacts: Clean-up and remediation of the solI and ground ~ater ~tamination viii be implemented in conformance witb Department of Health Services (OOHS) and Bay Area Air Quality Management District (BAAQMO) regulations. Demolition of the e~lstinq structures will be coordinated with DOHS and construction of the project would be. postponed if deemed neoessary. A detailed clo$ure plan 1s currently being reviewed by OOHS and air sampling will be conducted, as necessary to meet BAAQMD requirements. Groundwater treatment vill c~'tinue and an appropriate area has been set aside for location of the groundwater e~traction wells and equipment. Additional issues of concern to city staff that are not covered in the OEIR are: Fire Department access: In order to have sufficient access for emergency vehicles. including fire apparatus, paramedics and police, to the rear portion of the buIlding, the applicant is proposing to pave the existing emergeDCy a~ess road on the Xerox site at 3333 Hillvie~ Avenue. This road is cur4ently surfaced with turf-block which the Fire Depart.ment does not find accep, table to carry the weight of fire apparatus, particularly when the turf-block becomes soaked with water while fighting a firea Entrance ~rives and entrance court: Transportation Division has Riner concerns related to the length of ~rive required to get to the front entrance to the project for Foothill Expressway and the layout of the parking and drop-off area at the front entrance court. The concern is that the visitor will find the access and visitor parking areas confusing and disorienting. A possible solution vould require relocation of the Foothill Expressway entrance to be relocated to a point near the entrance to the building; ho~ever, this &elution could have adverse impacts on the Foothill ExpresswaY/Hillvie~ Avenue intersection. Staff believes that the applicant should further review the layout of the visitor parking area. prior to review by tbe ARB~ to determine if a more standardized layout of parking spaces can be Obtaineda {See attached memo from Carl Stoffel} Parking lots: Transportation Divi~ion has a .inor concern that the two parking lets on either side of the ~ilding . , I f: t· r,' ~~ ~. , . ' ~." " fii!' - o will not receive cars on a balanced basis. In partlcular~ the concern is that the lot closest to Hillviey will fill first and cars may spill into ~riveways and no parking areas rather than utilize the more secluded ~est parking lot. The applicant has indicated a willingness to assign some employee parking if this becomes a problem. Minor a~justments need to be made to the parking lot to limit any single row of cars to no more than ten before a landscaped island is required. OOMPREHENSIVE PLAN COMPLIANCE The project is qenerally consistent ~ith the Comprebensive Land Use Plan. In particular, the project is consistent vith the map designati~n of Researc~/Office Park l the housing policy by providing for hous1ng mitigation ~ees, transportation programs by pro~iding a TDM program and transportation mitigation fee~ by promoting bicycle use, and urban DesIgn Policies for ~aintaining a visually aesthetic environment. The p~oject is not consistent vith the Comprehensive Plan in that it does provide for an increased employment of approximately 350 new jobs on site and it does not provide for child care facilities on an ind, ustrial site. RE'COKMEND~TIOI Staff recommends that the Planning Commission comment on the O~aft Environmental Impact Report and recommend to City council approval of the site and design proposal, and forward the application to the ARB for design review and comment 00 the DEIR. J'nmINGS Recommendation for approval is based on th~ following findings: 1. The project as proposed will not bave a significant impact on the physical environment since the applicant bas agreed to incorporate measures l described in the OEIR 1 that vi}l mitiqate potential transportation I housing and hazardous material impacts to an acc~ptable level. 2. The office building design is consistent and compatible with the Limited Industrial/Research Park District Comprehensive Land Use Plan designation on the site. 3. CONDJ!rONS In addition to complying wIth the conditions and mitigations as defined in the DEIR dated April 1990, applicant sball address the folloyinq issues prior to revIew by the ARB: 1. Provide a preliminary grading and drainage plan t.o the satisfaction of the ~lic works Oepartment~ 2~ Revise the parking lot ~o provIde for landscape islands after every tenth parking space and to create a more standardized visitor parking/drop off area at the front of the bQilding. 3. Revise the landscape plans to preclude the use of any plant that viII grow to a natural beight above 30· in all landscape areas adjacent to intersections in the parking lots. 5. Bicycle lockers must be fitted with tubular key lock mechanism. 6. Sidewalks adjacent to each cluster of bike lockers must be a minimum of 5 feet vide~ 7. On page 26 .. the EIR stated that moving the Foothill driveway nearer to or in front of the ~ain project entrance would not be feasible .. but it did not fully discuss this option. Such a detailed discussion should be pr-ovided~ We had suggested that more spaces be provided in the eastern parki~ lot. to preclude an imbalance between the two lo,ts. The n~er of Class I bike facilities shown on page 1 is 65 lockers~ The lockers come in multiples of two. I believe the correct o·umber is 64 lockers, based on the estill\oted size of each bike locker grouping. 2. The man, ufacturer given for the Class I facilities. Bike Lockers LTD~. is acceptable. The lockers must be fitted vlth tubular key lock mechanlsm~ The barrel bolt lock which is also ~entioned in the manufacturer's specificaticns is not acceptable. 3. The sidewalk area surrou, nding each cluster of Class I bike lockers must be a minimum of 5 ft. wide. The plans now indicate only 4 ft. C. The visitor ~ike parking is sbown on page 1 (Master Site Plan) as being adjacent to the vis tor auto court and drop off area. But on page L.2 (Courtyard Plan) the visitor bike ra~ks are located near the employee parking lots. The latter location is not acceptable. The O-Lok style of vistor bike racKs is acceptable, however.
