Members of the council:
This report recommends that council award a contract to Plan
construction company in the. amount of $84 •• 70 for the expansion of
the office area at the Animal services Building. FUnds have been
appropriated in crp 18908 and the Public Works Department
Facilities Management Divisio·n FY 1989-90 operating budqet~

In response to the MSC Master Plan :Report of May 1987. this project
will ~reate a multi-purpose work area to accommodate office space
for the volunteer coordinator and a :meetinq room for staff and
volunteers. This project also will incorporate replacement of an
existing sewer line that would no~ally be done as a Facilities
Rehabilitation project.
Discussion
Bids were received from five qualified contractors as s~ on the
attache4 summary. staff recommends that. the bid of $84,,470
submitted by Plan Construction Company be determined by council to
be the lowest responsible bid and that the contract be awarded
accordingly.. This bid is approximately 11 percent above the
engineer's estimate of $75 .. tSOO. Staff bas reviewed the bid and bas
determined it to be competitive.
RecommE!ndations
staff recommends that Council~
1.. Approve and authorize tbe Mayor to execute the attached
construction contract with Plan construction company in the
amount of $84 .. 470 for the Animal Services Office Expansion
Project.
2. Authorize the City Manager or his designee to negotiate and
execute one or more chanqe orders to the construction contract
with Plan construction company. the value of all of which
change orders shall not exceed $10,0 1010.

amount specified in his bid in the manner provided in said
Standard Specifications dated 1972 1 as amended~
Concurrently with the execution of this contract, Contractor
shall provide City with the contractor's Labor and Material
and Faithful Performance. Bonds and certificates of insurance,
includiT19 any 'Worxer's co"[I]pensa:ticn insurance required by t.he
laws of the state of Cal ifornia or otherwise required in saId
speci fieations.
5. This contract snall not be ~ssigned by Contractor.

All claims by Contractor regardinq extra work" charges" delay
or other disputes arising out of the Agreement :']lUst be
submitted to City in ~ritinq vitbin ten (10) working days
after the claim arose" describinq in detail the nature and
value of the disputed ~ork or claim.
Contractor hereby agrees to indemnify, defend and hold
harmless City. its officers, agents, employees from any and
all demands" claims or liability of any nature" caused by or
arising out of Contractor's, its ctficers'p ~gents· or
employe~s' negligent acts, errors, or omissions, or willful
Bisconduct.. or conduct for ~hich the law imposes strict
liability on Contractor in the performance or nonperformance
of this Agreement.
This Agreement represents the entire Agreement between the
parties with respect to the purcbase and sale of the
equipment, materials, or supplies or payment for services
which may be the subject of this Contract. All prior
agreements, representations, 6tate~ents~ negotiations and
undertakings whether oral or writte~ are superseded hereby.
IN WITNESS WHEREOF. the Parties to these presents bave hereunto
set their hands all on the day and year first above written.
