ORDINANCE OF THE COUNCIL OP THE CITY OF PALO ALTO
APPROVING AND ADOPTING A PLAN FOR THE DEVELOPMENT
OF THE FABER TRACT, BEING A PORTION OF BYXBEE PARK
AND THE CITY-OW?IBD BAYLA.NDS
WHEREAS, Section 3 of Article VIII of·. the Charte~ of,. the·
· City of Palo Alto requires that before' any substantial buildinq,
construction, reconstruction or development is commenced or
approved upon or with respect to any land held by the City for
park purposes the Council shall first cause to be prepared and
-.by ordinance approve and adopt .!i plan therefor; 4nd
WHEREAS, the City Council did, by Ordinance No. 2252 adopted

September 13, 1965, place Byxbee Park and the City~owned Baylands
on the list of lands used or intended to be .. uaed for park 'purposes;

WHEREAs,.the·council p:t'oposes to.proceed with development of
the Faber Tract (the .. 95-acre, more or' less, portion of the lands
of the Ci,ty of Palo Alto, purchased from the Faber Estate, enclosed '

by a levy and lyinq adjacent to and northwesterly of San Francisquito
Croek)~ beinq ap0rtion of Byxbee Park ~d the City~ed Bayl.anda,
pursuant to a plan prepared therefor,

raiain9 its 9eneral grade to a suitable level. The character and·
type of fill and the location of its deposit within the boundaries
of the Faber Tract shall be-aubject to the approval of the City
Engineer but shall include both hydraulic and nonhydraulic dredging
spoils from the Palo Alto Yacht Harbor and from flOOd control
projects of 'benefit to the City of Palo Alto. S~id plan recognizes
and approves the use of othe~ lands heretofore or bereaft~r dedi
cated for park purposes for the transport thereover of ·such earthen
_fill to the Faber Tract. Said development plan shall remain in
effect until the COuncil determines that' the grade of the Fabe~
Tract is suitable for the beat park, play9roW1d, recreBtion or
conservation uae of said land.
SECTION 3. This ordinance shall become effective upon the
