DEPINITiONS,,
The followinq words and phrases whenever used in
this division shall be construed as detined,in this section:
- ----------------. fr;, "Drive-In --Restaurant" -shall.-mean-any-este.blitJh,lnent-
where food and/or beverage is sold to the consumer and where
motor vehicle parkinq space is provided, and where such food
and/or beverage is intended to be consl1med in the motor
vehicle parked upon the premises; or an}-where on the premises
outside of the buildinqe
b. "Licensee" shall mean a person having a city license

either without transacting any business or purchasing any food
or beverage therein~ or for the purpose of loitering.

without such regulations, drive-in restaurants are liable to

SEC. 28.03 LICENS!L REguIREM'ENTS ~·

the premises between the hours of 12:00 midnight.and 7:00 a.m.
except that on Friday and Saturday night, persons may be
served until 1:00 a.m. the following morning. Customers must
vacate the premises within 30 minutes after the conclusion of
serving hours.
SEC. 28.07 MINORS ON P~"MISES.
~-· No person under the age of 21· years shall--be.
permitted upon the premi..ses of a drive-in restaurant after
12:00 mignight unless accompanied by his parent or legal
guardian. ·

on the premises of a drive-in restaurant after 10:00 p.m.,
unless accompanied by his parent or legal guardian.
c. Licensees· shall post at least ·two' notices readi_ng
as follows:

PERSONS UNDER 16 YEARS OF AGE MUST LEAVE PREMISES
BY 10:00 P.M .. " . . .

c. A license shall provide adequate receptacles for the
disposa"i of waste material. .All persons shall ·place all waste ·
material in such receptacles. The licensee·shall, at least
every 24 hours, and more often if necessary, dispose of the
accumulated waste materials and otherwise keep.the premises
clean and sanitary.
d. · No parson on the premises of a drive-in restaurant
whether in or out of a motor vehicle, shall drink, have in his
pgssessj.9n, ·or ~i._411der his control, or offer to sell or give.
to another to drink any-alcoholic bevertfg~; pr6Vided,--however,-· -
that this provision shall not apply to any person lawfully
served inside the building by a drive-in restaurant duly

f. The licensee shall not permit, nor shall any

SEC. 28.09 FREE ACCESS TO OFFICERS
, No licensee, nor any other person shall prevent any
City,.; State or Federal .Peace or Fire Prevention officer
charged with the duty of enforcing the police laws of their
respective jurisdictions from having free access at all times
to any drive-in restaurant •

a. No person shall operate a drive-in restaurant unless
there be present at all times it is· open ·to the publJc at
least one person twenty-one (21) years of age or older. who is
devoting his entire time and'attention to the activity on the
premises.
b. No person shall beemployedin any capacity at a

(1) Is at least 16 years of age;
(2) · It: of good character; ·
(3) Has read sections 28.05 through 28.10 of this
Division.

DIVISION 2 REFRESHMENT STANDS

. SEC. 28.20 PERMIT AND CONDITIONS THEREFOR
Fqr the benefit of the public at public events or gatherings
within or adjacent to the City, where large bodies of people may
congregate or gather, the,Health Officer may gr.ant permits for
the erection. ooerationand maintenance of refreshment stands.
