L~{_~1~ L~-.i ORDINANCE NO. z3o5 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO ADDING SECTION 2.222 TO THE PALO ALTO MUNICIPAL CODE, AMENDING SECTION 27.17 AND REPEALING SECTIONS . 25.02 AND 25.04 THEREOF RELATING TO THE POWERS AND DUTIES OF THE HEALTH OFFICER The council of the City of Palo Al~o does ORDAIN as follows: ". ' SECTION 1. Section 2.222 is hereby added to Chapter 2 of the Palo Alto Municipal Code, to read as follows: 11 SEC. 2.222 HEALTH OFFICER The City Manager, with the approval of the council, shall appoint a Health Officer who shall be a person suitably trajned or experienced in public health administration. The City <.;ouncil may contract wi.th the County of Santa Clara, . pursuant to' th~ provisions of. Sections 480, et seq. of the Health and Safety Code, . for the performance by Health Officers or other employees of the County of any or all ftmctions ?:'elating to the enforceme.nt in, the City. of all ordinances relating to public health and sanitation, and the making of all inspections and the performance of r.11 functions in connection therewith. · ·Whenever the tenn 'Health Officer' is used in this Code1 without limitation, it shall mean and include City· Health Officer .... and any-other duly authorized Health Officer, or his qualified representatives or droputies. · The duties of the Health Officer shall be as follows: 1. He shal 1 have . general power to ~nspect,. examine, isola 't:'e, quarantine, .placard and disinfect.p~r&oris, places and things within the.City. 2. He and his duly authorized deputies shall have authority. a~d power, and shall be permitted, in the course of their duty, to enter into and upon, and to inspect any and ~11 lands,. places,. vehicl.es, buildings and structures, and the contents thereof;, within the City. 3. He shall have power to e>ifunine, or cau~e to be examined by c:l. li9ensed phy~ician designated by·hirn for such examination; an'y'person within the City· known or reason­ a.}?ly suspe~tea· to be afflicted with an~/ communicable · disea~e. , Provided, howevet', that in lieu of said exami­ nation such person may_as an.alternative ~e placed in . quarantine, ·the release from which shall be· cond.itioned upon evipence,.by physical and.laboratory examinations, that the di.sease no longer exists •. 4. To mak·e such additior.al rules and· regulations as may be necessary to secure the proper sanitation of all restaurants or food establishments and for the proper and orderly administration of this Chapter. 6. He shall perform such other duties as may be required by the City Manager or the City Council." SECTION 2. Sections 25.02 and 25.04 of the Palo Alto Municipal Code are hereby repealed. as follows: "SEC. 27.17 INTERFERENCE WITH HEALTH OFFICER PROHIBITED No person shall refuse, resist or attempt to resist the entrance of a Health Officer into any railway car, vehicle, building, room, lot or other place, or portion thereof, in the performunce of his duties, o~ resist, hinder or interfere with the Health Officer in the performance of any examination, or refuse to obey any lawful order of a health officer made in the performanCP. Of ilis duties Within the power conferred l,lpon him by this Code or by any law of the City or law of the State." SECTION.4.
