N AN ELECTRIC ?.AILWAY ON UNIVERSITY AVENUE AND WAVERLEY ST?l!ET IN THE CITY OF PALO ALTO TO BE NO LONGEP. IN FOECE AND EFJ'ECT. The Council of the City of Palo Alto DO ORDAIN ae follows: THAT WHEREAS, on the 16th day of Au~ust, 1903, the Town of Palo Alto p~ased Ordinance 8'94 of said .town, as an emer_gency ordinance, which. said ordinance purported to grant to John 1. Parkinson and assigns, etc .. the right to construct and main­ tain an electric railway on University Avenue and Waverley Street in the Town of Palo Alto; and WHEREAS, thereafter# the Feninsular Railway Company became and is the assignee of said et_r;~t r-ailway franchise and is now and has been cperating the street railway upon said University Avenue and Wa.verl ey' Street in the City of .?alo Al to, the successor of the Town of Palo Alto: and _, WHEREAS, application has been made to the Railroad Commission of the State of California by the said .Peninsular Railway Company to abandon ea.id franchise; and WHEREAS, said application has been acted upon by the ?.ailroad Commission of the State of California, and an order of said Railroad Commission made thereon, permitting said ienineular Railway Company to abandon its said franchise and street railway system in the City of Palo Alto: NOW, THEREFOP.E, IT IS HEP.EBY OP.DERED, that said 'franchise gran.ted by Ordinance #94 be and the sa::.ne is hereby declared to be no longer in force and effect from and efter JuJ.y 6, 1925, the ef1·ective date of said order of the Railroad Commission above referred :to, permitting said .Peninsular P.ailway Company to abandon its stl"3et railway s~tem ia said city, save and except that under the provisions thereof and of this ordinance, it shall be encumbent upon said Peninsular Railway Compan3.to remove any and all obstructic,ns on account of rails and ties, poles and appurtenances theretos within said city within a reasonable time after said order of the Rail­ road Commission, and before said ~~reets upon which ~ said traoks of said company are l;.iid, are improved. After said a·ban.donment, no chargr.: or assessment for new street work is to be made against said company.
