HomeMy WebLinkAboutORD 3135•• t' T ' • , ORDINANCE NO. 3135 ;;;.....-:~--~~ ORDINANCE o:r TID] COUNCIL OF THE CITY OF PALO ALTO AMENDING SECTION 18.08.040 OF THE PALO ALTO MUNI­ CIPAL CODE (THE ZONING MAP) TO CHANGE THE CLASSI­ FICATION OF PROPER·ry KNOWN AS 1766 EMBARCADERO ROAD/2500 FABER PLACE FROM P-C (PLANNED COMMUNITY) TO LM-(D) (LIMITED INDUSTRIAL/RESEARCH PARK DISTRICT/ SITE AND DESIGN REVIEW) AND AMENDING OBDINANCE NO. 2365 The Council of the City of Palo Alto does ORDAIN as follows: ~l'E:CJION L SecU.on 18.08. 040 of the Palo Alto Municipa 1 Code, the "zoning map," is .l"H9reby amended by .:-!.hanging the zoning of a port l.on of that certain property known as 1766 Embarcadero Road and 2500 Faber Place from P-C (f-lannc~d Community) to LM-(D) (L:lmi.ted Industrial/ Resef!_rch Park D:istrj ct I Site and Desir~n Review) as shown on the map at­ tached hl?.teto and marked Exhibit 1 'A, 11 and inc.orpora ted herein by this reference. Section 3 of ordinance No. 2365 adopted July 24, 1967, re­ zoning 1766 Embarcadero Road to P-C is hereby amended by modifying the Development Plan adopted thereby to delete from said plan that certain portion of the property hereby rezoned from P-C to LM(D) and all improve­ ments shown in said area on the Development Plan. Improvements shown in the Development Plan and immediately adjacent to the boundary of the sub­ ject premises are hereby amended as shown on the plans attached hereto as Exhibit 11 B'' and inco1·po:rated hel'ein by re.fert..~nce. SECTION 2. Sub,\?ection 1 of Section 4 of Ordinance No. 2:365 is here­ by amended to read as follows: " 1 . U.st) : New and used automobile sales and service? and paint and body repair. Week-end operating hotirs shall generally be limited to 9:00 a.m. -6:00 p.m., Saturday. and 11:00 a.m. -6:00 p.m., Sunday; provided, that adjustments may be made for seasonal sales events and simi la.r events. n SECTION 3. Subsection 2 of Section 4 of Ordinance No. 23e5 is hereby amended 'to:r.ead as follows: "2. Im_Erovements: a) Building locations, dimensions, setbacks, off-street parking and all other improvements shall be substan­ tially as shown <.m the approved Development Plan; b) La~dscaping shall. be substantially as shown on the approved Development Plan with the following condi­ tions: l.) The combination of public and private trees and Jandscaplng along Embarcadero Road and Faber Place shall make a continuous screen above eye level. Tha landscaped berm along Embarcadero Read shall be increased in height to 30" above the existing interior parking lot, and land­ scap.ing upon said berm shall be increa.sed in accordance with plans to be approved by the Architectural Revi~w Board, which sball be de­ signe~ to minimize disruption to any existing landscaping. .. Y r --------------------~~--------............ ... • 2) The side perimet9r planting area shall have a minimum width of six (6) feet where trees occur and a minimuw width of fou:r (4) feet otherwise. A landscaped strip of eight to ten feet (8'-10') shall be provided along the rear line of the dis­ trict. 3) Planting in the interior of the parking area shall have a minimum dimension of six (6) feet. 4) Planting areas for trees shall be planted with suitable ground cover and shrubbery. c) Signs shall be shown on the approved Development Plan pro­ vided that the signs shown meet the requirements for signs in the CS District. Addit.ional stgns shall be 1 irni ted to those identifyjng the buildings shown on the Site Plan as Used Cars Sales/S~rvice, and Paint/Body Repair; such signs shal.l be subject to the approval of the Zoning Administra­ tor. d) A six-foot high wooden fence shall be substituted for the six-foot high security chain link fence in the vicinity of the future auto museum and to its c.onnec.tion with the Paint and Body Shop. e) All driveway openj.ngs onto Embarcadero Road shall be used only for entry to the property. All exits shall be located on Faber Place. Egress points on Faber Place shall be clearly designated on the property and neces­ sary lines or directional signs shall be installed. f) No flags, banners or similar advertising mechanisms shall be used on the subject property. g) Subject to approval of the Architectural Review Board, additional signs sball be erected to designate and en­ courage the use of off-street parking facilities by employees and customers. h) Modifications shall be made to the existing loudspeaker/ intercom system to reduce the nofse level generated by that system and to insure, to the extent feasible, that the sound generated by that system will be limited to the boundaries of the subjec.t property." SECTION 4. Except a.s specifically amended hereby, all provisions of Ordinance No. 2365, including all aspects of the Development Plan not ex­ pressly amended her~by, shall remain in full force and effect. ' SECTION 5. The Council finds that the adoption of this Ordt.r.ance will liive no significant adverse environmental impacts. SECTION 6. The Council fi.nds that the rezoning of the above prop­ erty is consistent with tne P&.:to Alto Comprehensive Plan. SECTION 7, This ordilJ.ance shall become effect.ive upon the cormnence­ ment of the thi:rty-fi.rst day following thf! date of its passage. -2 - .. • l .
