The Council of the City of Palo Alto does ORDAin as folloHs:
SECTIOH l, Section 12.12. ()10 of the Palo Alto t1unicipal Code
is hereby amended to rend as follmvs:

encroachment permTt. Ho person shall erect, con-

building 1 structure, sign, fence, paving or portion
thereof upon any easement, right of way or parcel
of land conveyed, granted or dedicated in any
manner to the city for street, draina3e, sewer or
public ut~lity purposes, provided that the city
manager or his designee may grant a revocable
permit to the o~mer to cons true t such s true ture
or to do such Hork ~vhen in his opinion the con
struction and maintenance thereof Hould not
interfere with any city facilities located in
such eas~ment and \vould not be detrimental to
the best interest of the city. Such permit
would be subject to revocation at any time by
the city manager or his designee and would he
subject to such terms and conditions as the city
man&3er or his designee may consider reasonable
for the protection of the best interests of the
city including hut not limited to provisions that
the permittee shall hold the city, its officers,
agents and employees f:ree and harmless from any
liability for injuries to persons or property
resulting from the construction or maintenance
of such encroacb.ment and that the removal of the
structure when so requested by the city manager

exper,se. Such permit may also provide that upon
failure of the permittee to remove such structure
within a reasonable time after notice from the
city manager or hts designee the same may be
abated.and removed by the city and. the cost
thereof made c. lien upon the property pursuant
to the provisions of Chapter 9.56 of hi:s code.11
SECTIOH 2. This shall become effective upon the cornmencement
nf the thirty-first day after the day of its passage.
