Chapter 16.16 (Elec.trical Code) of the Palo A :I to ~1un] ci pa1 Codf) is amended to read as set forth in Exhibit ''A" attached hereto n.nd i.ncorporated herein by this reference, S~CTIO~. Sal d chango!'; are, there­ fore, subject to the validating provisions of Section 17958,7 of the California Health and Safety Code. SEC~_ON 3. Notwithstanding and in addition to the contents of Section 2, above, the Council hereby makes the following findings with respect to the provis.ions of Exhibit "An: a) The findings made by the Councjl of the City of Palo Alto in Ordinance 2600, adopting the 1968 National Electrical Code are he:r.eby re.af firmed, the findings adopted as a. part of Ordinance 281.1 relating to the adoption of the 197] National Electrical Code are hereby reaffirmed, the provisions of Reso­ lution 5373 are hereby reaffirmed, and the findings adopted as a part of Ordinance 2998 relating to the adoption of the 1975 National Electrical Code are hereby reaffirmed, and ex­ pressly made applicable to such changes as are hereby adopted~ readopted, runended or carried through without significant change. b) The Council hereby finds that the changes contained in Section 16.16.020 of Exhibit ".P.'' relate to enfm.·cement of the Electrical Code and are necessary for its application. Pursuant to California Health and Safety Code Section 17960 the Building Department of the City is charged with the :duty to enforce the provisions of the Electrical Code. The prov i.s :l ons e .. Hd:ai ned in Section 16.16.020 are contemplated within and are a neces­ sary adjunc~ to said duty and are not in conflict with the Electrical Code. Said provisions also establish uniformity of definitions between the various codes. c) The Council hereby finds that the changes contained in Section 16.16.030 o:f Exhib.it "A" establish testing and approval standards for all materials. Authorization for provision of such proced­ ures i~ established by Sectj.on 110.2 and the definition of "Approved" contained in Article 100 of the Electrical Code. Said change constitutes s~ecification of what is required by --------------------------------------------------------------------------------------------- ., ' • • the Electrical Code and is contemplated and necessary adjunct to the duty to enforce. The Council further finds that more specific testing and approval proeedures than are provided in the Electrical Code are required by local conditions including, but not limited to hazardous geologic conditions. d) Section 16.16.040 of Exhibit "A" establishes the duties for enforcing the Electrjcal Code and a procedure for issuance of permits under the Code. The Council hereby finds that adoption of such procedures is required and contemplated by Health and Safety Code Section 17960, is not inconsistent with, and does not constitute a change to the El~ctrical Code, Differences in administrative procedures between various jur­ isdictions constitute local conditions necessitating the adop­ tion of such provisions, e) The Counci 1 hert:by f:.Lnds that preva.l en t types of J oc,n.l eonst ru­ c.t1 on and living pat terns require more sp0)Ci f :l c 1 oca t 1 on for outdoor outlets than ts provided in the .Electr:ica.l Code and that said facts constitute local conditions necessitating tl1e changes contained in Section 16.16.050. In addition, the Council further finds that local conditions exist which require the changes of Section 16,16.050 by reason of the age of the existing housing stock in the City which genc~rates substantial work and remodellings performed by homeowners, which necessitates additional safety requirements. f) Section 16.16.060 requires compliance with the requirements of the L',~pa rtr,lent of Utilities, Division of Light and Power of the City. The Council finds that the existence of a muni­ cipally owned and operated electric utjlity is a local condi­ tion necessitating this increase in sco~e and coverage, in order to permit the safe and efficient operation of utilities services in a manner comparabl.e to that of private utility companies. g) The City Council finds that local conditions necessitate the changes contained in Section 16.16.070; including but not limited to the need to clarify code requirement as to installa­ tion procedures and to define hazardous locations, and also local physical condltions such as extreme geologic hazard. h) The Council finds that local conditions necessitate the changes contained in Section 16.16.080; including but not limited to the age of the existing housing stock in the Ci t.:t wh:l...:;:i. promotes remodelling by homeowners. The construction methccls >ar;-aitted by Article 320 of the Electrical Code tend to promote dangerous practice in the course of such remodelling. The Council further finds that the use of the methods contained in said Article are no longer prevalent within the City. i) The Council finds that J.ocal conditions exist which necessitate the changes contained jn Section 16.16.090; including but not limited to the fant that the type of construction permitted by Article 333 of the Electrical Code tends to be inadequately grounded n.nd is otherwise hazardous in installation, and pre-· 8ents an i~creased danger in an earthquake-prone area.
