ORDIHAHCE OF THE COU!WIL OF Till CITY OF PALO ALTO
REPEALING EHER.GENGY ORDINAUCE NO. 311.5 TO REGULATE
TIL~ POSTING OF HOURS OF OPERATION OF' GASOLINE STATIOUS
The Council of the City of Palo Alto does ORDAIN as follows:
SECTION 1. The emergency ordinance~ Uo. 3115, adopted by the
Councfr"'""o:t:"" the City of Palo Alto :ts hereby repealed.
SECTION 2. The Council finds that this ordinance is an emergency
ordinance aff"ect:i.ne the health, safety, and '\velfare of the City of
Palo Alto and its citizens. The facts supporting such emergency are:
(a) Subsequent to the adoption of Ordinance No. 3115 the
Governor of the State of California has declared an emergency due to
the existing gasoline shortage and has included the entire County of
Santa Clrr.1..·a, including the City of Palo Alto, in his dec.la:cation.
(b) The Governor 1 s Executive Order has the force and
effect of law and is generally preemptive of the City of Palo Alto
Ordinance No. 3115.
(c) It is inappropriate to maintain two ordinances ad
dressing the same subject matter where confusion wiJ.l be created
because of duPlication. Moreover, enforcement of the two laws,
each possessi;1g different penalty provisions, is potentially detri
mental to both t:he pubU.c and law enforcement.
SECTION 3. The Council finds that this is not a project under
the carfror11.fa Environmental Quality Act and, therefore, no environ
mental impact assessment is nece.ssa:r.y,
SECTIOH 4, This ordinance shall b~ effective immediately.
