HomeMy WebLinkAboutORD 3119.. • • ORIGINAL ORDINANCE NO, 3119 --- ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO DELETING SECTION 16. 08. 0.50 OF THE PALO ALTO HUNI­ CIPAL CODE AND REINSTATING SECTION 612 OF THE UNIFORM PLUMBING CODE RELATING TO CHEMICAL WASTES, AND DECLARING URGENCY The Council of the City of Palo Alto does ORDAIN as follnws: SECTION 1. Section 16.08.050 of the Palo Alto ~~ninipal Code is hereby"repeili·d and deleted from Chapter 16.08 of th(:' Palo Alto >h .. ,nicipal Code. SECTION 2. The City Council hereby finds that Chapter 16.09 of the Palo AfE()11unicipal Code, adopt.ed by Ordin<1nce No. 2726 on July 2., 1973, pt·ovi.des for the regulation of indus trial \·las te dischax·ge in co t.he Cit\·' s sewerage system. Howev~r, that Chapter does not contain specific regulA­ tions regarding plumbing standards to be used in industrial buildings. By adopti.on of ordinance No. 3054 on May 1, 1978, the City Cot..mcil enacted Chapter 16.08 of the Palo Alto Municipal Code, adopting the 1.976 edition of the Uniform Phunbi.ng Code, w:l'.th amendments. By adopting Section 16.08.050 of the Palo Alto Municipal Code the Council inadvertently de­ leted Section 612 of the Un:tfonn Plumbing Code, which contains plumbing standards with regard to industrial wastes, without providing alternate requirements. As a rest:lt ~ the City presently has no such special require­ ments in effect. Therefore~ the possibility exists for the installation of an acid or corrosive waste system to be installed with nonapproved materials ~-lhich could result in breakdo\on.1 of the sys tern with resultant damage to the physical environment and/or harm to persons or animals. The Council further finds that there are presently under construction or in the planning stages seve,ral industrial deve-lopments within the City which ¥.Till utilize industrial waste systems. Based upon these findings: the Council he.reby declares that this ordinance is necessary as an. emergency measure for the public peacet health or safety. This ordinance shall become effective irranediately upon its passage .. SECTION 3. 'fhe Council hereby finds that the enactment of this ordinance ~s not a "project" within the meaning of the CaU.fornia Envirom12encal Quality Act.
