Subsections (a)(l) of Sections 18.37.070, 18.41.070, 18.43.070, U3--:-t+S.O?O, 18.55.070, and 13.60.070 of the Palo Alto Municipal Code are hereby amended by addi~b the following language at the end of each such subsection: ••. . . SECTION 5. TI1e text of subsection (e) of Section 18.83.110 of the Palo Alto Municipal Code is hereby amended to read as follows: n (e) . Parkin~ facility design. Subsectlon (i) of Section 18.23.050 of the Palo Alto Municipal Code is hereby amended to read as follows~ II (1) !:!,_eisht. The rnaxirm..1I1l height shall be 10. 7 meters (35 feet). However, no structure except television and radio antennae shall extend above or beyond a daylight plane having a height of 3.0 meters (10 feet) at each site line and an angle of 45 degrees." SECTION 9. Subsection (a)(l) of S~ction 18.68.150 of the Palo Alto Municipal Code is hereby amended to read as follows: "(l) The maximum height shall be estab:ished by daylight planes, measured from each lot line, identical to t~e daylight plane requirements of the most restric­ t~ ve I_IB, R~l,· R-2, RM or applicable residential PC districts abutting each such lot line. SECTION' 10. Subsection (a)(l) of Section 18.45.070 of th~ Palo AltO Mur~Icipal Code is hereby amended to read as follows~ ~1 (1) Residencial de~s~~t· For exclusive residential use of any si.te, t e minim.urn site area per dwelling unit shall be 232 square meters (2~500 square feet) for the first dwelling unit and 83.6 square meters (900 square feet) for each additional dwelling unit.. For mixed residential and non-residential use on any site. the minL~ura site area per dwelling unit shall be 90 square meters (968 square feet). In computing residential densities for ~ixed r~sidential and non-residential uses. there shall be no cleduct:l.on for that portion of site area in non-residential use,'' -3- • • SECTlOH 11. Section 18.88.090 of the Palo Alto Municipal Code ls hereby amended to read as fol.lows· (a) (b' .I nlD.38.090 Projections into ~s. Cornices, eaves, ~ireplaces, and siDilar Brchi~ . tectural featu~es, excl~dinn flat or continuous walls or window surfaces or enclosu~es of usable interior space, may extend into a required side yard a distance not exceedinB 0.6 meters (2 feet), or may extend into a required front or rear yard a distance not exceeding 1.2 meters (4 f~et)" A canopy or patio cover may be located in any residential district in the required rear yard or that portion of the iriterior side yard which is more than 22.9 neters (75 feet) from the street lot line measu?:ed alone the comnon lot line. Such canopies sh:ill l:'-e subject to the follm•''ing condi,­ tions: (1) A canopy or patio cover shall not be more than 3.7 meters (12 feet) in height. (2) The canopy or patio cover shall be in­ luded in the computation of building coverag<a. (3) The canopy or patio cover and other structures shall not occupy mot'e than 50 percent of the required rear yard. (4) The car1opy or patio cover shall not be enclosed on more than two sides. (c) Structures not over 1.3 meters (6 feet) in height or 2.3 square meters (25 square feet) in floor area, used exclusively for storage purposes~ may extend into a required side yard a distance not exceeding 0.6 meters (2 feet), or may extend into a required front or rear vard a distance not exceeding 1.2 u'eters (4 feet). • (d) Uncovered porches, stainvays landings. or fire escapes may extend not More than 1.8 meters (6 feet) into a required front or rear yard, and may extend not more than 0.9 meters (3 feet) into a re~ quired side yard. SECTION 15. Chapter 18.82 of the Palo Alto Municipal Code is hereb~ed by adding Section 18, 82. 055 thereto to read as follows: (a) (.b) (c) (d) "18.82.055 [\.ppli~ation proces!?.. The app1icant seeking Site &. Design approval shall initially submit to the Planning Commission a site plan and elevations as described in Section 18.32.050. The plans and elevations may be pre- 1~.rninary in nature but must show all pertinent informa.tion requested by the Zoning Administrator. If the Planning Comrn.ission re,conrnends denial, the application and preliminary plans shall be for­ warded directly to the City Council. If the Planning Commission recommends approval, a detailed site plan and elevations consistent with the Planni.,..,r~ Co1nrrdssion recommendation shall be forwarded to the Architectural Review Board for review pursuant to regulations in Chapter 16.48 of the Municipal Code. The plans and elevationsf as approved by the Planning Commisrsion and the Architectural Review Board~ are submitted with recomme.ndations to Council for final action.ti -5- • • SECTION 16. Subsection (56) of Section 10.04.030 of the Palo Alto Hunicipal Code is hereby amended to read as follows· l.od~int unit. A room or group of rooms, not Inc udng a kitchen, used or intended for use by overnight occupants as a single unit, wh~ther located in a hotel 01· a dwellins unit providing lodging. Where designed or used for occupancy by more than two persons, each two persons capacity shall be deemed a separate lodging un:tt. For the purpose of determing residential den.sity. each two lodging units shall be corn:ddered the equivalent. of one dwelling unit. 11 SECTION 17. Subsection (b)(3) of Section 13.43.070 of the Palo Alto }[micipal Code is hereby arn1~nded to re~1d as follffws · 11 (3) On any portion of a site in the CC district which abuts a site in any RE, K·l, R~2, HJ! or applicable PC di.strict, a minimum interior yard of 3, 0 me.ters (10 feet) shall be required, and a solid wall or fence of between 1.5 and 2.4 meters (5 and 8 feet) in height shall be constructed and maintained along the corrmton site line. The minim\i.:,'TI in tcr ior v ard shall be planted and maintained as a landsca~ed screen. 11 SECTION 18. Subsection (c) of Section 18.47.040 of the Palo Alto Hunicipa!-Code is hereby amended to read as follows· . "(c) Pa::..~ing and vehicu~ar access ~estricted. Vehicular access to s rt es aaJ oinfilg designated pedestrian sidewalks er pedestr!anways which requires vehicular movement across such pedestrian sidewalks or pedes­ trianway~~ shall be prohibited, except where requir-ed by law or as may be authorized by a use permit issued in ac-cord with Chapter 18.90." SECTION 19, Subsection (b) (2) and (b) (3) of Section HL 88. 030 oi:' the· Palo Alto Mtinicipal Code are hereby amended to read as fol­ lows: . . "(2) ' II (3) No such accessory building shall be located in any portion of a t'equired · interior side yard which is · less than 1.8 meters (6 feet) from thl? side lot line and less than 22.9 meters (75 feet) from the street lot line, measured along such side lot line. No such accessory building shall he located in any po:r.tion of a rear yard which is less than 1.8 meters (6 feet) from a lot line which is the side lot line of an adjoining lot and is less than 22.9 meters (75 feet) fro:m a street: lot line, measured along the common lot line." SECTION 20. Subsection (h) of Section 18.68.090 of the Palo Alto Municfpal Code is hereby amended to read as follows· A parking and loading plan~ showing the number of spaces and the location~ internal circulation, and dimensions of all park.inB and loading areas. • • The parking and loading plan shall be based upon the requirements of Chapter 13,33 unlees requested modifications to meet the needs of the individual project are supported by traffic engineering studies or relevant data. as may be required by the Zoning Administrator. demon­ strating the feasibility and adequacy of the plan." SECTION 21. Section 18, 6iL 110 of the Palo Al to Municipal Code is hereby-amended to read as follows~ "18. 68 .110 Act~n by Coffi!nis s iqg. In addition to the requirements of Chapter 13,98, the Planning Commission shall review and consider all materials submitted by the appl:i.ca.n.t pursuant to this Chapter, and shall prepare and recommend to the City Counc :Ll, as approp:ria te the sped .. f ic regulations to be applied within the proposed Planned Go~anunity District. The specific regula­ tions may modify those regulations contai.ned in Chapter~ 18.83 to 18.99, inclusive, as is appro­ priate to meet the individual district. and shall J',nclu.de the fallowing; (a) Pe.rmitted uses~ A liscing of all uses to be permitted generally within the district or the uses to be permitted in specifi.c: locations within the district as shmvn on th~ develop­ ment plan. (b) Conditional uses: A listing of all uses to be conditionally allowed within the district, or to be conditionally allowed in any specific location within the district as ohown on th-e development plan. (c) Site development regulations: Maximum or minimum regulations, as appropriate·' governing site dimensions, :requirP-d yards and distances between buildings., site coverage; bu.ilding height, residential density, floor area ratio, open space requirements~ accessory facilities and uses, and other aspects of the proposed development within the district. The regula­ ions may be in text~ or by reference to the devt::lopment plan, or both. It1 no event shall t:he maxim:um height exceed 15. 2 meters {50 feet) except as provided' in Chapter 18.90. (d) Parking and loading requirements, Regulations establishing off ~·street parki.ng and loadinB re­ quirements for the district,, and governing design~ location, screPning, landscaping and operation of· parking and loading activities. The regulations IDqy be by reference to Chapter 18.83J or in text if the regulations of Chapter 13.83 are modified for the individual district, or b?th. Su.ch regu­ ations may include additional hei3ht limitation9, yard requirements, landscaping and screening, provisions governing outdoor activities, and other requirements, (f) Development plan and development schedule. The development plan submitted pursuant to Section 18.60.090 shall, and the development schedule submitted pursuant to Section 18.68.100, as amended or approved by the Planning Commission; shall be reconunended for inclusion in the regulations applicable to the PC :·1e.nned Communi.ty District, (g) Definitions; Definitions applicable specifically to the regulations :r.econmiended for the district r::iay be iriclude<L 11 SECTION 22. Section 18.68.020 of the Palo Alto Municip~l Code ls hereby~amended to read as follows; "18. 6n. 020 ~J21?.li~~:i.hilli.Y of. regulations. The specific regulations of this Chapter and the additional regulations and procedures established by Chapters 18.83 to 18.99, inclusive, shall apply to all Planned Community Districts. Notwithstanding the regulations of Chapter 18.33 to 18.99. inclusive, where specific regulations are adopted pursuant to Sections 18.68.110 and 18,68.120, the specific regulations so adopted shall apply to that Planned Community Di.strict." SECTION 23, The Council of the City of Palo Alto finds that the changes to Title 18 of the Palo Alto Municipal Code contained herein are requir~d by the public interest and general welfare. SECTION 24. The Council hereby finds that adoption of this o:rdinance w!1! not have any significant environmental impact. SECTION 25. This ordinance shall become effective upon the commence.ment of the thirty-first day after the day of i.ts passage.
