HomeMy WebLinkAboutORD 3142• • ORIGINAL ORDINANCE NO. 3142 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDIHG SECTION 12.16.020 OF CHAPTER 12.16 OF TITLE 12 OF THE PALO ALTO MUNICIPAL CODE BY ESTAB~ LISHING Uf\TJ)ERGROUND UTILITY DISTRICT NO. 20 AND DECLARING AN EMERGENCY The Council of the City of Palo Alto, California, does ORDAIN as follo~1s ~ '·rHERF..AS, this Council did, on April 30 1 1979} adopt its Resolu­ tion. No. 5678 of Intention to Amend Secti0n 12.16.020 of Chapte!' 12.16 of Title 12 of the Palo Alto Municipal Code by Establishing Under­ ground Utility District No. 20 in said City and appointed Monday, the 25th day of June, 1979, at the hour of 7:30 o'clock p.m. :Ln tl:e Council Chambers, City Hall, 250 Hurnilt:on Avenue, Palo Alto, California, as the time and place of hearing prott~sts and receiving evidence for and against said proposed action and directing notice; vJHEREAS, notice was given of the time and place therein stated in the manner provided by lmv, as appears from the affidavits on file in the office of the City Clerk; "THEREAS, said matter ca.me o.n regularly for hearing at the time therein fixed; and . WHEREAS, all written protests and other written communications were publicly read at said meeting and evidence duly ta.ken and all persons desiring to be heard were fully heard; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED as follows: 1. The public necessity, health and safety require the removal of poles and overhead lines and associated overhead structures from that certain area described in said Resolqtion No. 5678. 2. Section 12.16.020 of Chapter 12.16 of Title 12 of the Palo Alto Municipal Code is amended by adding Subsection (20) therE~to, said Subsection (20) to read as follows: u (20). District No. 20. All la:nds within the area of the City of Palo Alto bounded by Hamilton Avenue, Channing Avenue, Lincoln Avenue and Center Street." 3. 'l'he "Underground Utility District Mapt' referred to in said Section 12.16.020 shall be amended to add the areas shown on the map referred to in said Resolution No. 5678. 4. An urgency exists affecting the.-public health, safety, and welfare and ·necessitating an irm:ned:!.ate effective date of this ordi·· nance in that: (a) There. currenth,. is a potential threat to public safety both to citizens and City E>.mployees caused by an aging overhead sys teu1; • • (b) A delay in the construction of the proposed under­ ground system will cause substantial increases in costs which must be paid both by the City and the underground district's property owne:t:s. 5. This ordinance ~hall become effective immediately.
