ORDINANCE NO. 2835
ORDINANCE OF THE COUNCJ.L OI<' THE CITY OF PALO ALTO
ADDING SECTION 16.04.185 TO THE PALO ALTO MUNICIPAL
CODE; IDENTIFYING AU AREA OF THE CITY AS A POTENTIAL
SPECIAL FLOOD HAZARD AREA AND ADOPTING SPECIAL LAUD
USE AN'D CONTROL MEASURES TO BE APPLIED vHTHIU SUCH
AREA
The Council of the City of Palo Alto does ORDAIN as fol
lows:
SECTION 1. Section 16.04.185 is added to the Palo Alto
Municipal Code to read as follows:
"16.04.185 Xhncial flood hazard area. (a) The
FIA FLOOD HAZ BOUNDARY MAP, No. H Ol-13, for the
City of Palo Alto, Connnunity No. 060348, as promulgated
by the Secretary of Housing and Urban Development on
June 28, 1974, and revised by the City of Palo Alto on
December 6, 1974, is hereby adopted for the sole purpose
of complying with the requirements of the National
Flood Insurance Act of 1968, its amendments, and th~
regulations which have been adopted pursuant th~Yeto.
For the purposes of the National Flood Insuran~e
Program~ the Council hereby directs that a copy of
said map shall be kept on file in the Division of
Inspectional Services and shall be used pursuant to
this section as hereinafter set forth.
(b) The director of public works-city engineer
shall consult with the Santa Clara Valley Water District
and those persons in charge of administering flood pl<::~.:l
management programs in the communities which border on
the city of Palo Alto so as to take into account flood
plain management programs in effect in neighboring areas.
(c) The provisions of this section relating to
land use and control and other measure8 designed to
reduce flood losses shall take precedence over any other.
provisi.ons of this code which are in conflict.
(d) The building official shall review building
permit applications for major repairs within the flood
plain area having special flood hazards, No building
permit shall be issued unless the building official
determines that the proposed repair {1) uses construction
materials and utility equipment that are resistant to
flood damage and (2) uses construction methods and
rrractices that will minimize flood damage. The term
'major repairs 11 as used in this subsection means any
rep~~ reconstruction, or improvement of a structure,
the cost of which equals or exceeds ten percent of
the actual cash value of the structure before any
repair takes place. The applicant for a permit hereunder
shall present drawings, plans,specifications and
any other data or information which the building official
may require.

(e) The building official shall review building
permit applicationo for new construction or substantial
improvements within the flood plain area having special
flood hazards. No building permit shall be issued unless
the building official determines that the proposed
constructionr including prefabricated mobile homes, if
any are pennitted pursuant to the provisions of Title 18,
(1) is protected against flood damage, (2) is designed
or modified and anchored to prevent flotation, collapse
or lateral movement of the structure, (3) uses construction
materials and utility equipment that are resistant to
flood damage, and (4) uses construction methods and practices
that will minimize flood damage.
The.applicant for a permit hereunder shall present
drawines, plans, specifications and any other data or
information which the building official may require.
The term "substantial improvements 11 as used in this
subsection means any repair, reconstruction, or improve
ment of a structure, the cost of which equals or exceeds
fifty percent (50%) of the actual cash value of the
structure either before the improvement is started or,
if the structure has been damaged and is being restored,
before the damage occurred. Substantial improvement is
started when the first alteration of any structural part
of the building commences.
(£) The director of public works-city engineer
shall review subdivision proposals and proposals for the
miscellaneous division of land upon the filing of a
tentative or preliminary map pursuant to the provisions
of Title 21. No· tentative or preliminal:"y map shall be
approved unless the director of public works-city
engineer determines that (1) all such propos~ls.are
consistent with the need to minimize flood damage, (2) all
public utilities and facilities such as sewer, gas,
electrical~ and-water systems ~re located, elevated and
constructed to minimize or elim5.nate flood damage, and
(3) adequate drainage is provide~ so as to reduce exposure
to flood hazards, The director of puoii~ works-city engineer
shall require new or replacement water supply systems and
sanitary sewer systems to be designed to minimize or
eliminate infiltration of flood waters into the systems and
discharges from the systems into flood waters and require
on-site waste disposal systems to be located so as to
avoid impairment of them or contamination from them during
flooding.
(g) The term "structure 11 as used in this section means
a building which is used for residential, business, agri
cultural, manufacturing, recreational, or religious purposes
or ·~:,lhich is occupied by a private nonprofit organization,
or which is owned by the state or an agency thereof or by
a local governmental agency. The term includes a building
while· in the course of construction, alteration or repair,
but does not include the building materials or supplies
intended for use in such construction, alteration, or repair
unless such materials or supplies are within an enclosed
building on the premises.

(h) Nothing in this section or the issuance of
any permit or approval hereunder warrants in any way
that flooding or flood damage will not or cannot occur
in any area wi.thin the corporate limits of the city of
Palo Alto. t'
SECTION 2. TI1e Council of the City of Palo Alto finds
that the enactment of this ordinance will have no significant
environmental impact.
SECTION 3. This ordinance shall become effective upon the
commencement of the thirty-first day after its adoption.
