4.54.vl0 Pur~ose ~~d intent. It is the purpose and
intent of t.his chapter to provide for the orderly regulation
of massage establishments and massage technicians, as defined
herein, in the interests of the public health, sa.fety, and
welfare by providing certain minimum building, sanitation,
and health standards for massage estc.bl.ishments, and by
providing certain minimum qualifications for the operators
of massage establishmeHtE and for massage technicLms and
massage technician t.rainee~/5
4.54.020 Definitions. For the purpose of this c!lapter,
unless the context clearly requires a different meaning,
the words, terms and phrases hereafter set forth shall have
the meanings given them in this section:

(1) ~Massage" means any method of pr2usure on, or
friction against, or stroking, kne.ndin';!, rubbing, tapping,
pounding, vitn:ating 1 O:!:" stimulating the~ external pwrt!3 of
the human body with the hands or \'lith the aid ci any
mechanical electrical ~pparntus, or other nppliances or
devices, with or without such supplementary aids as rubbing
alcohol, liniment, antiseptic, oil, powder, cream, lotion,
oin't-4uent, or other simila.r preparations.,
(2) "Massage establist~ent" means any.esta~lishrnent
having a fixed place of business where any individual, firm,
association, partncrshipr corporation-joint venture, or com
bination of individuals cnqaacs in~ conducts, carries on or
permits to be engaged inr ~onducted or carried on massages,
h;:,.ths, or hsalth treatment:; :i_:n-volv.:.ng massage or baths as

trainee as reqaired by this chaptero

v1ho has complied with thC.! requirements of sections 4. 54. 050
nnd 4.54.110 of ·this chapter unless:
(1) The epplicant knowingly made a material mi:J
sta~e~ent in the application for a license; or
(2) The applicant has, within three (3) years immediately
preceding the date of the filing of t~e application, been
convicted in a court of competent jurisdiction of un offense
involving conduct which re~uires registration under California
ranal Code Section 290, or anv viol3tion of Sections 311
through 311.7~ 313.1, 314, 31S, 316, 318 or 647(a), 647(bj,
647(d), or 647(h) of the California Penal Code, or of any

addition to the requirements of Chapter 4.04 aud the foregoing,
any applicant shall furnish the following information:

period of three (3) years :bnmediate.ly prior to the date of the
application and the dates of residence at: each.
(2) Written proof that; the-applicant is at le:\st: eighte~n

4.54.070 Massa~e technician application fee." .r.~ny
application for a permit to act as a massage technician shall
!;~accompanied by a nonrefundable fee of ten dollars f~lO).
The application fee shall be a one time only i:"ee used to defray,
in part, the costs of invest:~_gation and rer-ort. Any person who
applies for a license to operate a massage establisP~ent and who
desires to act as & massage technician within said establish
ment shall no ; be required to pay the fee requirt.~d by t:his
section, but shall be required to furnish the information
required by Section 4.54.080.

Any application or a pern;i:= to act as a massage technician shall
be made '\vith the city· treai;·urer.. Hithin ~ifteen (15) -working days
following receipt of a completed application, the chie~ of police
shall either issue the permit, or mail a written .>tatement of
his reasons fer denial thereof. If he takes neither action abovn,
the-permit shall be deemed to be issued. The chief of police may
reques.t the applicc:nt to furnish fingerprints when needed for the
ptlrpose of est2blish~.ng identification. In addit:ion to the
requirements of Chapter 4.04, the applicant shall fu~ish the
following information:

to employ the applicant to do massage as a trainee working
under the direct supervision and control of a massage technician
who has received a permit under the provi~ions of this chapt~r.

No fee shall be required of a maasag~ r~chnician trainee
applicant. The trainee must ctt CJ.ll times :o~rply \·7i'i:h r.he 1.at.-vs

may render the trainee . ineligible to obtain a massage
technician permit.
Any massage technician trainee ':~7ho, during the life of
the trainee pcmit, completes the ins tructiori requi:r·ed of a
massage technician, .shall be isst:.ed a massage technician
perm:! .. t upon payment of the ten dollars ($10) massap~ techni
cian application fee.
4.54.100 A.epeal. In the event a pemit or license
ar?lication has been denied. ::he applicant shall proceed pur
suant to the appeal and hear:i.ng pr0\7 isions in Chapter 4. 04.

reQUirements. All massage establishments shall comply with
the following facilities and operations requirements:
(1) Massage establishments shall comply with all code
requirements.
(2) A m:!..ni:mc.m of one (l) tub or shower • ':'".d one (1)
toilet and wash basin shall be provided in ever:,"' •·t~ssage
establishment.
(3) Cabinets or. other covered space shall be provided for
the storage of clean linen. Approved receptac~es shall be
provided for the storage of all soil~d linen and paper tm~els.
(4) Minimum ventilation shall be provided in accordance
with the Building Code of the City of Palo Alto. To allow
fo:--adequate vet1.tilat:i.on in cubicles, rooms and areas pro
vided for pat~ons' use. which a~e not serviced directly by
required window or mechanical systems of ventilation, par
titions shall be constructed so that the he:3ht of p:1rtitions
does not exceed seventy-f:ve percent (75%) of the floor-to
ceiling height of the area "in whi.ch they are located.
(5) All plumbing and ·electrical installation8 shall be
installed under permit e:nd .. inspection of the bui !ding in
.spection department and such inst:allations shall be installed
in :tccordance \\'ith the uniform building code and the uniform
plu.'ll.bing code.
(6) The walls in all rooms \vhere water or steam baths
are given shall have a wa&hable, mold-resistant surface.
(7) All lavatories or wash basins shall be provided with
hot und col(~ rnnnin:~ water~ .;oap and single-sc:!:'vice tm"els
in \\lall-raounted dispensers.

quanti.ty. Tu'!.·Jels·, sheecs and linens shall not be used by
more th<m one ( l) person. Reuse o£ such lirl'--".n is prohibited
unless the sar.1e has first been laundered. 1Icnvy 1.mite paper
may be substituted for sheets provided that such paper is
used once for each person and then discarded into a sanitary
recep'Cacle.
(11) All walls, ceilings, floors, pools, showersJ
bathtubs, steam rooms, and all other physical facilities for
the establishment must be in good rep~i.r and maintaiiKd in
a clean and sanitary condition. Wet and dry heat rooms,
steam or vapor rooms, or steam or vapor cabinets, shoHe·L·
compartments and toilet rooms shall be thoroughly cleaned and
disi..nfect:ed each day the business is in operation. Bathtubs
shall be thoroughly cleaned and disinfected after each use.
(12) Disinfecting agents and s~erilizing equipment shall
be provided for any instruments used in perfc~ing acts of
massage and said instruments shall be disinfected and
sterilized after each use.

4.54.170 Exem?tions. This chapter shall not apply to
the following classes --or-individuals t-7hile eng~ged i-..~ the
?erformance of the duties of their respective profes3ions:
(1) Physicians, surgeons, chiropractors, OGtcc~at:ns
or physical therapists who are duly licensed to practice
their respective professions in the stat_e of California.
(2) Nurs~s registered under; -the laws of the -state
California.
(3) Trainers of any amateur, semiprofessional or
professional atnlete c~ ath1~tic teAm.

(4) Barbers and beauticians who are duly licensed under
the la"':vS of the state of California.
4.54.180 Grounds for denial, disci
action. The provisions oi: Section 4.04.1 0 sha l apply
licenses and permits required under this chapter.·
4.54.190 Hearing. Any licensee or permittee whose
license or per~it has been suspended or revoked shall proceed
pursuant to the appeal and hearing provisions o£ Chapter 4.04.
4.54.200 Application to existing establishr.ents and
technicians. All operators o£ existing massage, bath, or
llealtn treatment establishffients, and all persons engaged in
giving massage, bathing. and heal~h trear.menLs in the ci~y
of Palo Alto upon the effective date of ~his ch~pcer shall
comply with all application and o~hcr requirements within -
thirty (30) days following ~he effective doLe of this chapter.

4.54.210 Applicntion of other code nrovisions. Chapter
4.04 of this cede shall apply to the st.i-~ct: matter of this
chapter in all respects, including those no~ sp~cifically
mentioned in this chapter.0
SECTION 2. The Council of the City of Palo Alto hereby
finds that th~·-enactment ·of· this ordinance is not a 11 project''
within the meaning of that· term· as defined in Section 11.04.130
of the Palo Alto Hun~_cipal .Code and, therefore, no environmental
assessment is necessary.
SECTION 3. This ord~nance shall become er:r:ect:ivc upon
the commencement of the thirty~first day after the date of
its r:tssage.
