It is the purpose and intent of t.his chapter to provide for the orderly regulation of massage establishments and massage technicians, as defined herein, in the interests of the public health, sa.fety, and welfare by providing certain minimum building, sanitation, and health standards for massage estc.bl.ishments, and by providing certain minimum qualifications for the operators of massage establishmeHtE and for massage technicLms and massage technician t.rainee~/5 4.54.020 Definitions. For the purpose of this c!lapter, unless the context clearly requires a different meaning, the words, terms and phrases hereafter set forth shall have the meanings given them in this section: -1 - '· ./.-.· ,.... ~ .. ,_ -~ -~ ... The application fee shall be a one time only i:"ee used to defray, in part, the costs of invest:~_gation and rer-ort. Any person who applies for a license to operate a massage establisP~ent and who desires to act as & massage technician within said establish­ ment shall no ; be required to pay the fee requirt.~d by t:his section, but shall be required to furnish the information required by Section 4.54.080. 1~-. 54. 080 ~Plication· for mac sage ·tech.ni.cian p~1.~it. All massage establishments shall comply with the following facilities and operations requirements: (1) Massage establishments shall comply with all code requirements. (3) Cabinets or. other covered space shall be provided for the storage of clean linen. Approved receptac~es shall be provided for the storage of all soil~d linen and paper tm~els. (4) Minimum ventilation shall be provided in accordance with the Building Code of the City of Palo Alto. To allow fo:--adequate vet1.tilat:i.on in cubicles, rooms and areas pro­ vided for pat~ons' use. which a~e not serviced directly by required window or mechanical systems of ventilation, par­ titions shall be constructed so that the he:3ht of p:1rtitions does not exceed seventy-f:ve percent (75%) of the floor-to­ ceiling height of the area "in whi.ch they are located. (5) All plumbing and ·electrical installation8 shall be installed under permit e:nd .. inspection of the bui !ding in­ .spection department and such inst:allations shall be installed in :tccordance \\'ith the uniform building code and the uniform plu.'ll.bing code. Wet and dry heat rooms, steam or vapor rooms, or steam or vapor cabinets, shoHe·L· compartments and toilet rooms shall be thoroughly cleaned and disi..nfect:ed each day the business is in operation. Bathtubs shall be thoroughly cleaned and disinfected after each use. (12) Disinfecting agents and s~erilizing equipment shall be provided for any instruments used in perfc~ing acts of massage and said instruments shall be disinfected and sterilized after each use. This chapter shall not apply to the following classes --or-individuals t-7hile eng~ged i-..~ the ?erformance of the duties of their respective profes3ions: (1) Physicians, surgeons, chiropractors, OGtcc~at:ns or physical therapists who are duly licensed to practice their respective professions in the stat_e of California. (2) Nurs~s registered under; -the laws of the -state California. (3) Trainers of any amateur, semiprofessional or professional atnlete c~ ath1~tic teAm. o:t' (4) Barbers and beauticians who are duly licensed under the la"':vS of the state of California. 4.54.180 Grounds for denial, disci action. The provisions oi: Section 4.04.1 0 sha l apply licenses and permits required under this chapter.· 4.54.190 Hearing. Any licensee or permittee whose license or per~it has been suspended or revoked shall proceed pursuant to the appeal and hearing provisions o£ Chapter 4.04. 4.54.200 Application to existing establishr.ents and technicians.
