HomeMy WebLinkAboutORD 2814I '· , f • ORIGINAL ORDINANCE NO. -2.8l.JL_ AN ORDINANCE AMENDING SECTION 12.16~020 OF CHAPTER 12.16 OF TITLE 12 OF'THE PALO ALTO MUNICIPAL CODE BY ESTAB­ LISHING UNDERGROUfiD UTILITY DISTRICT NO. lr( The Council of the City of Palo Alto, California, does ordain as follows: \-fHEREAS, this Council did, on July l , 19?4, adopt its Res olu­ ti.on of Intention r-ro. 4960 to establish Underground Utility District No. 17, and appointed the 12th day of August, 1974, at the hour of 7:30 o 1 clock P.M. in the Council Chambers, Chric Center, Palo Alto, California, as the time and place of hearing protests and receiving evidence for and against said proposed action and directing notice; WHEREAS, notice was given of the time and place therein stated in the manner provided by law, as appears from the certifi.cate on file in the office of the City Clerk; WHEREAS, said matter came on regularly for hearing at the time therein fixed; and WlffiREAS, all written protests and other written communications were publicly read at said meeting and evidence duly taken and all persons desiring to be heard were rully hear.d; ffOW, THEREFORE, IT IS FOUND, DETERM~NED and ORDERED, as follows: 1. The public necessity, health and safety require the removal of poles and overhead lines and associated overhead structures frorn that certain area described in said Resolution of Intention No. 4960. 2. That this Council further finds and determines that such undergrounding is primarily in an area of local public benefit. 3. That Section 12.16.020 of Chapter 12.16 of Title 12 of the Palo Alto Municipal Code is amended by adding Subsection (17) ' ., . . • • thereto, said Subsection (l'r) to read as follows: 11 l'f. Dtstrict No. l'f. l\11 lands within the City limits of the City or Palo Alto bounded by Florence Street, University :\venue, Ramona Street and Lytton Avenue, exccptine the parcel at the southeasterly intersectton of Florence Street and Lytton Avenue and the t\'IO parcels lying southeasterly and southl·resterly thereof fronting on f.1 lorence Street and t.ytton Avenue, respectively, removal ninety (90~ days after comple­ ti.on and acceptance of the WQrk. ' 4. The "Underground Utility District Maps" referred to in said'Section 12.16.020 shall be amended to add the area ahomt on the map referred to in said Resolution No. 1~960. 5. This Ordinance shall become effective upon the expira- tion of thirty (30) days rrom its passage. * * * * The foregoing Ordinance was duly and regularly introduced at a regular meeting or the Cow1cil or the City of Palo Alto held on the 12th day of August, 1974, and was thereafter at a regular meeting held on the 26th day of August , 1974, duly and ----- regularly passed by the following vote: AYES: NOES: ATTEST: Berwald.
